Title

SUMMARY & BACKGROUND:

This Ordinance authorizes Agreement between City and ISS, for access, use, enjoy, and benefit from ISS case management software in addition to their license(s) maintenance and support. The Agreement is for five (5) years at a cost not to exceed Three Hundred Thirty Eight Thousand Three Hundred 00/100 Dollars ($338,300.00).

 

Summary

NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:

 

SECTION   1.  The Mayor, the Municipal Court Judges, and the Municipal Court Administrator are authorized to enter into an Master Software License and Professional Services Agreement with exhibits and schedules that provides a case management software license, maintenance and support as well as professional services to Toledo Municipal Court for up to a five (5) year period, upon terms acceptable to the Director of Law.    

 

SECTION   2.  The competitive procurement requirements under Toledo Municipal Code Chapter 187 are waived as it is found and determined that it is in the best interest of the City that contracting with ISS is the most cost effective and secure manner to obtain the needed maintenance, support and service for the probation’s case management software. 

 

SECTION   3.  The expenditures of funds is authorized in an amount not to exceed Sixty Five Thousand and 00/100 Dollars ($65,000) for year one of Agreement from the Account Code 2090-10800-3T003016STDSTD and also authorized is the expenditure of funds in future years from same Account Code as a continuing obligation, subject to the appropriation of funds. 

 

SECTION   4.  That the expenditure of funds in future years for software maintenance and support services in accord with the terms of Agreement as authorized in Section 1 is authorized from Account Code 2090-10800-3T03016STDSTD as a continuing obligation subject to the appropriation of funds in future years.

 

SECTION   5.  The Finance Director is authorized to draw his warrant or warrants against the above referenced account code in payment of the above obligations upon presentation of the proper voucher or vouchers.

 

SECTION   6.  This Ordinance shall be declared to be an emergency measure and shall be in force and effect from and after its passage.  The reason for the emergency lies in the fact that the same is necessary for the immediate preservation of the public peace, health, safety and property and for the further reason that the Ordinance must be immediately effective in order to provide necessary case management software support for the efficient and effective operation of the Toledo Municipal Court Probation Department.

 

                     Vote on emergency clause:  yeas 12, nays 0.
