SUMMARY & BACKGROUND:

The leachate collection system, at the Hoffman Road Landfill, has old deteriorated infrastructure that failed.  Emergency services were required in December 2019 to complete temporary repairs to piping that broke and prevented leachate pumping activities at the landfill.  These emergency repairs did not hold up due to the deteriorated condition of the piping, which has left the leachate collection system only partially functioning and unreliable with minimum contingencies. The leachate collection system was scheduled to be repaired by Geo. Gradel Co. on February 10, 2020.    Complete failure of the leachate collection system will result in a leachate back-up at the landfill, regulatory noncompliance conditions, and Ohio EPA violations.  Because of these reasons, this is deemed an emergency.

 

Toledo Municipal Code (TMC) 187.20 allows for the waiver of competitive bids and for the emergency work to be undertaken.  Furthermore, TMC 187.20 requires Council to be informed of the emergency and for authorization to pay the repair.  Sufficient funds are available within the Solid Waste CIP budget to pay for this emergency repair.

Summary

NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:

 

SECTION 1.  That the amount of $48,888 is authorized for expenditure from the Capital Improvement Fund Account Code 5040-24500-8CP1912HRLEQP to Geo. Gradel Co. for emergency leachate collection system repairs.

 

SECTION 2. That this Council finds and determines it is in the best interest of the city to waive the competitive procurement provisions of TMC Chapter 187 for the reason that the system repairs are an emergency and necessary to avoid regulatory violations, permit noncompliance and exponential costs.

 

                     SECTION 3. That the Mayor is authorized to enter into a contract with Geo. Gradel Co. for the repairs authorized in Section 1.

 

SECTION 4.  That the Finance Director is authorized to draw his warrant or warrants against the above mentioned Account Code, in an amount not to exceed the amount authorized in Section 1, in payment of the obligation or obligations above authorized upon presentation of the proper voucher or vouchers.

 

SECTION 5.  That this Ordinance is declared to be an emergency measure and shall be in force and effect from and after its passage.  The reason for the emergency lies in the fact that same is necessary for the immediate preservation of the public health, safety and environment and for the further reason that this Ordinance must be immediately effective in order to comply with TMC 187.20 and authorize the payment of the emergency leachate collection system repairs at the Hoffman Road Landfill.
