SUMMARY & BACKGROUND:

The City of Toledo needs testing and related engineering services for numerous construction contracts that the division administers. The Division of Engineering Services and the Toledo Waterways Initiative are two of the primary users of these services.  Since numerous divisions utilize the same types of tests for their respective projects, the city has found it beneficial to have price determining contracts established that contain schedules of prices for commonly utilized testing and engineering services.  Funding for these services are contained in the various, individual, operating and project budgets authorized by council, and while singularly they represent a small portion of the projects’ costs, collectively they are sizeable enough that competitively bidding contracts for these services is desirable.  This ordinance authorizes solicitation of formal proposals and entering into price determining contracts for geotechnical and related engineering services from companies meeting the city’s geotechnical testing qualifications.

Summary

NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:

 

                     SECTION 1.                     That the mayor is authorized to prepare specifications, accept bids and enter into price determining contracts after due advertising according to law for geotechnical testing services and engineering services.  These services will cover design, control, testing and inspection of construction materials required in conjunction with the construction of street pavements, sanitary and storm sewers, bridges, buildings and other public improvement facilities under the direct control of the City of Toledo.  Contracts shall contain such terms and conditions as the mayor may deem requisite and proper and shall be subject to approval by the Director of Law and Director of Public Utilities with a contract period of one year with the option of two one-year renewals with terms and conditions as may be mutually agreed upon by the parties.

 

                     SECTION 2.                     That the funding for said contracts is contained within various individual projects and operating budget appropriations as approved by City Council. 

 

                     SECTION 3.                     That this Ordinance is declared to be an emergency measure and shall be in force and effect from and after its passage.  The reason for the emergency lies in the fact that same is necessary for the immediate preservation of the public peace, health, safety, and property and for the further reason that this Ordinance must be immediately effective in order to facilitate construction of important projects.
