Declaring it necessary to improve Elmer Drive at the southeast corner of the intersection at N. Holland Sylvania by installing street lighting; and declaring an emergency.

SUMMARY & BACKGROUND:

Toledo City Council has requested that the city install LED street lighting at Elmer Drive on the southeast corner of the intersection at N. Holland Sylvania to protect and provide nighttime safety to area residents.  The total annual cost for the operation and maintenance of the lighting is $111.48 to be paid from the Special Assessment Fund account.

 

Summary

NOW, THEREFORE, Be it resolved by the Council of the City of Toledo:

 

                     SECTION 1.                     That it is necessary to improve the following lots and lands by installing street lighting, as described below.

 

A.                     Elmer Drive at the Southeast intersection of N. Holland Sylvania by installing one (1) 90-watt, LED cobra style streetlight on wood poles with overhead service.

 

            SECTION 2.                     That the plans, specifications and estimates for this proposed improvement on file in the Division of Engineering Services are approved.

 

                     SECTION 3.                     That the lots and lands identified in Section 1 are specifically benefited by said improvement and each shall be assessed at a rate per assessed front footage.

 

                     SECTION 4.                     That the assessments to be so levied and assessed shall be levied and assessed annually in accordance with the Assessing Ordinance hereafter to be passed by City Council and said assessments shall be certified to the County Auditor to be placed upon the tax duplicate and collected as other taxes.

 

                     SECTION 5.                     That notice of the adoption of this resolution shall be by publication in the Toledo City Journal in the manner provided by law.

 

                     SECTION 6.                     That this resolution is hereby declared to be an emergency measure and shall be in force and effect from and after its passage.  The reason for the emergency lies in the fact that the same is necessary for the immediate preservation of the public peace, health, safety and property and for the further reason that this resolution must be immediately effective in order to expedite the installation of street lighting.

 

Vote on emergency clause:  yeas 12, nays 0.

 

Adopted:  December 10, 2019, as an emergency measure:  yeas 12, nays 0.
