Erie Toledo, Ohio 43604; authorizing an expenditures of $38,892.00 for the year, waiving the requirements of TMC 187 and making certain findings with respect thereto; and declaring an emergency.

SUMMARY & BACKGROUND:
This Ordinance authorizes an agreement between City, TMC and JAVS, for access to JAVS Preventative Maintenance, Support and Services in addition to audio and visual equipment for the court located at 555 N. Erie Toledo, Ohio 43604; the Agreement is for one (1) year (7/1/2019 through 6/30/2020) at a cost of $38,892.00.
Summary
NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:
SECTION 1. The Mayor, the Municipal Court Judges, and the Municipal Court Administrator are authorized to enter into an agreement for a one (1) year contract for access to JAVS Preventative Maintenance, Support and Services in addition to audio and visual equipment for the court located at 555 N. Erie Toledo, Ohio 43604. This includes an extended warranty that takes effect immediately upon the expiration of the original warranty. It also includes on-site service and remote phone support with the guarantee that all equipment will be repaired or replaced for a specified period of time after the expiration of the original warranty.
SECTION 2. The competitive procurement requirements under Toledo Municipal Code Chapter 187 are waived as it is found and determined that it is in the best interest of the City that contracting with JAVS is the most cost effective and secure manner to obtain the needed maintenance, support and service for the court’s audio and visual equipment.
SECTION 3. The expenditures of funds in the amount of $38,892.00 for the one (1) year contract are authorized from the Account Code 2090/10800/3T02923STDSTD, subject to the appropriation of funds.
SECTION 4. The Finance Director is authorized to draw his warrant or warrants against the above referenced account code in payment of the above obligations upon presentation of the proper voucher or vouchers.
SECTION 5. This Ordinance is declared to be an emergency measure necessary for the immediate preservation of the public peace, health, safety and property of the City, and for the further reason that this Ordinance is required to be immediately effective in order to contract with Justice AV Solutions for preventative maintenance, support and services for audio and visual equipment; wherefore, this Ordinance shall be in full force and effect immediately after its passage or at the earliest time allowed by law.
