SUMMARY & BACKGROUND:

Petitioner has filed a request to vacate a portion of 13th Street, in the Port Lawrence Division, in the City of Toledo, Lucas County, Ohio.

 

Summary

NOW, THEREFORE, Be it resolved by the Council of the City of Toledo:

 

                     SECTION 1.  That the City Council does hereby declare its intent to vacate a portion of 13th Street, in the Port Lawrence Division, in the City of Toledo, Lucas County, Ohio; further described below:

 

13th Street Vacation

(Between Washington Street and Monroe Street)

A parcel of land being part of 13th Street, as it now exists as shown in Port Lawrence Division, recorded in Volume 16 of Plats, Page 47, Lucas County Plat Records, City of Toledo, Lucas County, Ohio, said parcel of land being bounded and described as follows:

Beginning at the intersection of a line drawn forty and zero hundredths (40.00’) feet northerly of and parallel with the centerline of  Washington Street, as it now exists, also being the southerly line of Lot 683 of said Port Lawrence Division with a line drawn thirty-three and zero hundredths (33.00) feet westerly of and parallel with the centerline of said 13th Street, as it now exists, also being the easterly line of said Lot 683 in Port Lawrence Division, said point of intersection being marked with a set capped iron rebar,

Thence in a northeasterly direction  along said line drawn thirty-three and zero hundredths (33.00) feet westerly of and parallel with the centerline of 13th Street, as it now exists, also being the easterly line of said Lot 683 and Lots 682, 681, 680 and 679 in said Port Lawrence Division, having an assumed bearing of North thirty-three (33) degrees, ten (10) minutes, twenty-two (22) seconds East, a distance of four hundred ninety-three and thirty-seven hundredths (493.37’) feet to the intersection of a line drawn forty and zero hundredths (40.00’) southerly of and parallel with the centerline of Monroe Street, as it now exists;

Thence South fifty-six (56) degrees, forty-nine (49) minutes, thirteen (13) seconds East along said line drawn forty and zero hundredths (40.00’) southerly of and parallel with the centerline of Monroe Street, as it now exists, a distance of thirty-three and zero hundredths (33.00’) feet to the intersection of the centerline of said 13th Street, as it now exists, said point of intersection being marked with a set mag nail;

Thence South fifty-six (56) degrees, fifty-two (52) minutes, forty-four (44) seconds East continuing along said line drawn forty and zero hundredths (40.00’) southerly of and parallel with the centerline of Monroe Street, as it now exists, a distance of thirty-three and zero hundredths (33.00’) feet to the intersection of a line drawn thirty-three and zero hundredths (33.00’) feet easterly of and parallel with said centerline of 13th Street, as it now exists, said point of intersection being marked with a set capped iron rebar;

Thence South thirty-three (33) degrees, ten (10) minutes, twenty-two (22) seconds West along said line drawn thirty-three and zero hundredths (33.00’) feet easterly of and parallel with the centerline of 13th Street, as it now exists, also being the westerly line of Lots 676, 675, 674, 673 and 672 in said Port Lawrence Division, a distance of four hundred ninety-three and thirty-seven hundredths (493.37’) feet to the intersection of said line drawn forty and zero hundredths (40.00’) feet northerly of and parallel with the centerline of  Washington Street, as it now exists, said point of intersection being marked with a set capped iron rebar;

Thence North fifty-six (56) degrees, fifty (50) minutes, thirty-five (35) seconds West along said line drawn forty and zero hundredths (40.00’) northerly of and parallel with the centerline of Washington Street, as it now exists, a distance of sixty-six and zero hundredths (66.00’) feet to the Point of Beginning.

Said parcel of land containing an area of 32,562 square feet or 0.748 acres of land, more or less. 

 

The above described parcel of land is subject to any and all leases, easements and restrictions of record.

 

Said set capped iron rebar being a 5/8" diameter by 30" long iron rebar with a plastic cap stamped “PS 8112".

 

The bearings used hereon are based on an assumed meridian and are solely for the purpose of calculating angular measurement.

 

The above description is based on an actual field survey performed under my supervision during

July, 2019.

 

                     SECTION 2.  That this matter be referred to the Toledo City Plan Commission for its review, recommendation and appropriate hearing date.

 

                     SECTION 3.  That this Resolution hereby is declared to be an emergency measure and shall be in force and effect from and after its adoption.  The reason for the emergency lies in the fact that same is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that this Resolution must be immediately effective so that the vacation can be expeditiously completed to enable property owners to obtain the resulting benefits at the earliest time.

 

Vote on emergency clause:  yeas 12, nays 0.

 

Adopted:  October 15, 2019, as an emergency measure:  yeas 12, nays 0.
