SUMMARY & BACKGROUND:

The Criminal Justice Coordinating Council (CJCC) has recommended a sub- award to the City of Toledo for $40,359.38 from grant 2017-JG-A01-B2600 (Bureau of Justice Assistance- Edward Byrne Memorial Justice Assistance Grant Program) for the Forensic and Cybercrimes Section. The grant funds will be used to purchase a ThermoFisher Scientific Nicolet iS50 Fourier Transform Infrared Spectrometer (FTIR) to replace the current one that is over 20 years old and the company that provides service to the spectrometer stated that parts and services will cease because of the age of the machine.

 

This ordinance will authorize acceptance, deposit, appropriation, and expenditure of $40,359.38 from the Criminal Justice Coordinating Council, and authorize the expenditure of $20,275.62 from the General Fund. The total expenditure for the purchase of the ThermoFisher Scientific Nicolet iS50 Fourier Transform Infrared Spectrometer (FTIR) is $60,635. There is no cash match and the in-kind match requirement will be $13,453.13. The in-kind match will be personnel salary from the commander of the Forensic & Cybercrimes Section.

 

The fiscal impact of this ordinance is as follows:

Summary

NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:

 

SECTION 1.  That the Mayor is authorized to enter into a grant agreement and to accept and deposit grant proceeds from the Criminal Justice Coordinating Council Grant (Bureau of Justice Assistance- Edward Byrne Memorial Justice Assistance Grant Program) for the Forensic and Cybercrimes Section in the amount of $40,359.38 into the Operation Grants Fund.

 

SECTION 2.  That the appropriation of $40,359.38 is authorized from the unappropriated grant proceeds of the Operation Grants Fund to account 2016-52000-3G00041STDSTD; and the expenditure of same is authorized for the purchase of an Infrared Spectrometer.

 

SECTION 3. That an expenditure of $20,275.62 is authorized from General Fund, Account Code 1001-52000-3381002STDSTD, for the purpose listed in Section 2.

 

SECTION 4. That this Council finds it is in the best interest of the city to waive competitive bidding requirements of Toledo Municipal Code Chapter 187.  The reason for the waiver is due to the fact that Thermo Electron North America LLC Infrared Spectrometer is the sole spectrometer that can satisfy the volume demands of the police department crime laboratory.

 

SECTION 5.  That the Finance Director is authorized to draw his warrant or warrants against the above mentioned Account Code in an amount not to exceed $60,635.00 in payment of the above authorized obligations upon presentation of the proper voucher or vouchers.

 

SECTION 6.  That this ordinance is declared to be an emergency measure and shall be in force and effect from and after its passage.  The reason for the emergency lies in the fact that it is necessary for the immediate preservation of the public peace, health, safety, and property, and to operate and continue the program through the grant period.
