SUMMARY & BACKGROUND:
This Ordinance authorizes an agreement between TMC, the Board and the Facility for the provision of addiction diversion program services through the Facility's RAD program to criminal defendants in the TMC. The Agreement is for two-years (7/1/2019 through 6/30/2021) with a renewal option of 24 months (7/1/2021 through 6/30/2023). Any changes in fees and per diem rates for the extension period shall be included in the written agreement.

Summary
NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:

SECTION 1. The Mayor, the Municipal Court Judges, and the Municipal Court Administrator are authorized to enter into this agreement for a two-year term, with an option for a two-year extension, with the Board and Facility for the provision of addiction diversion program services through the Facility's RAD program.

SECTION 2. The competitive procurement requirements under Toledo Municipal Code Chapter 187 are waived as it is found and determined that it is in the best interest of the City that contracting with the Board and Facility is the most cost effective and secure manner to obtain the needed addiction diversion services.
