SUMMARY & BACKGROUND:

Biosolids are a byproduct of the waste water treatment process generated at the Bay View Wastewater Treatment Plant. The biosolids generated will be hauled off-site by the contracted company and disposed of by methods that will meet the Ohio EPA approved division’s recycling/reuse land application program. The terms of this contract are for five years with two additional two year extensions.

Summary

NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:

 

SECTION 1.                     That the mayor is authorized to enter into contracts for the Biosolids Recycling/Disposal Program for a five-year period with two additional two-year extensions upon such terms and conditions as approved by the Director of Public Utilities and the Director of Law.

 

SECTION 2.                     That the sum of $3,000,000 annually over the contract period authorized in Section 1 is authorized for expenditure from the Sewer Operating Fund, Account Code 6070-36000-4000531STDSTD, to pay the cost for the Biosolids Recycling/Disposal Program contingent upon the availability and appropriation of funds in the operating budget.

 

SECTION 3. That the Finance Director is authorized to issue his warrant or warrants against the account code identified in Section 2 in amounts not to exceed those authorized above in payments of the obligations incurred pursuant to the contract authorized in Section 1 upon presentation of proper voucher or vouchers.

 

                     SECTION 4.  That the ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage. The reason for the emergency lies in the fact that this ordinance is necessary for the immediate preservation of public peace, health, safety and property, and for further reason that this ordinance must be immediately effective in order to maintain the operation of the biosolids removal system which is needed to preserve the operational condition of the plant to meet permit requirements as set forth by the EPA.
