SUMMARY & BACKGROUND:

The Toledo Municipal Court was awarded the J.R.I.G from the State of Ohio Department of Rehabilitation and Correction effective December 1, 2017 - June 30, 2019.  The J.R.I.G included an incentive award provision that allowed the grantee to receive additional funds for successfully meeting specific performance goals related to offender treatment, jail population reduction/diversion, staff training and reduced recidivism.  A recent assessment of the Toledo Municipal Court Probation Department’s goal performance by the Department of Rehabilitation and Correction resulted in the issuance of the current Incentive award for meeting all incentive goals.  The Incentive Award expenditures shall be separate from any expenditure in the J.R.I.G total.

 

Summary

Now therefore, Be it ordained by the Council of the City of Toledo:

 

                     SECTION 1.  That the Mayor is authorized to accept an Incentive award in the amount of $95,401from the State of Ohio, Department of Rehabilitation and Correction, and deposit said amount into Account Code, 3G00072STDSTD, Probation Incentive Grant, 

 

                     SECTION 2.  That the sum of $95,401 is appropriated from incentive award proceeds in the Probation Performance Grant, Account Code, 3G00072STDSTD, Probation Incentive Grant; and authorizing said amount for expenditure.

 

                     SECTION 3. That the Mayor, the Municipal Court Judges and the Municipal Court Administrator are authorized to enter into necessary contracts and agreements, under the terms acceptable to the Director of Law, the State of Ohio, and the Ohio Department of Rehabilitation and Correction, to fulfill the purposes of the incentive award described herein.

 

SECTION 4.  That the Finance Director I authorized to draw his or her warrant against Account Code, 3G00072STDSTD, Probation Incentive, in an amount not to exceed $95,401 in the payment of the obligations authorized above upon presentation of proper voucher or vouchers.

 

                     SECTION 5.  That this Ordinance is declared to be an emergency measure and shall be in force and effect from and after its passage.  The reason for the emergency lies in the fact that same is necessary for the immediate preservation of the public peace, health, safety, and property and for the further reason that the Ordinance must be immediately effective in order to accept the incentive award funds for any community corrections program/service expenditure as defined by ORC 5149l.30 (A) by June 30, 2021.
