SUMMARY & BACKGROUND:
A sewer main (Sewer No. CO007) collapse in the sidewalk near 4136 Burnham Ave. occurred in early April 2019. Due to other repairs and all crews being assigned elsewhere, when the inspection section found multiple sanitary sewer laterals had collapsed in the center of Burnham that needed immediate repair, and to assure the safety of the citizens, the Department of Public Utilities (DPU) required the expertise and equipment available through a private contractor to complete repairs in April 2019. TMC Section 187 requires City Council to be informed of the emergency and for authorization to pay the repair and waiving the competitive bidding. Sufficient funds are available within the DPU operating budget to pay for this emergency sanitary sewer repair.

Summary
NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:

SECTION 1. That the sum of $27,023 is authorized for expenditure from the Sanitary Sewer Operating Fund, Account Code 6070-37000-4000558STDSTD, to Taylor Excavating for payment of the emergency repair at 4136 Burnham Ave.

SECTION 2. That City Council finds that it is in the best interest of the city that the competitive procurement requirements of Chapter 187 of the Toledo Municipal Code are waived for emergency repairs needed to maintain uninterrupted utility services and repair cost that has been deemed reasonable by the Director of Public Utilities.
