Enacting new Toledo Municipal Code Section 1112.0206(E), to require notification of District Councilmembers of cases pending before the Board of Zoning Appeals; and declaring an emergency.

SUMMARY & BACKGROUND:
The Board of Zoning Appeals is empowered to hear appeals concerning decisions of the Commissioner of Building Inspection related to enforcement of the zoning code and the sign code, as well as requests for variances. District Councilmembers have a particular need to be aware of issues affecting their district. It has been determined that District Councilmembers should be notified of appeals and variance requests pending on properties within their districts.
Summary
NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:
SECTION 1. That a new Toledo Municipal Code Section 1112.0206(E) is hereby enacted as follows:
TMC 1112.0206
(E) The Secretary of the Board of Zoning Appeals shall provide notice to District Councilmembers of any applications filed related to properties within their respective council districts at least fourteen days prior to the meeting at which such application will be considered.
SECTION 2. That this Ordinance is declared to be an emergency measure and shall be in force and effect from and after its passage. The reason for the emergency lies in the fact that it is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that it is necessary that Toledo Municipal Code changes be made to immediately start providing notice to District Councilmembers of matters affecting their council district.
