SUMMARY & BACKGROUND:

The West Oak Walk Business Association (WOW), a business organization in District 5, submitted a District Improvement Program application for the installation of eleven (11) decorative light posts on the north side of Sylvania Avenue between Douglas and Secor to enhance the quaintness of the business district. The lights would be in addition to the current light inventory, but would be more energy efficient and would be the first decorative lights in the area. Additionally, WOW proposes upgrading the existing thirty (30) streetlights to light emitting diode (LED) lighting for aesthetics and security. The District Improvement Review Committee convened on April 4, 2019, and recommended approval of this application in an amount not to exceed $115,320.

 

This resolution declares the necessity for the street lighting and begins the process for authorizing the assessment for future maintenance costs.  Subsequent legislation will be presented to authorize the expenditure of DIP funds for the installation of the new lights.

 

Summary

NOW, THEREFORE, Be it resolved by the Council of the City of Toledo:

                     

                     SECTION 1.  It is necessary to improve the Sylvania Avenue between Douglas Road and Secor Road by installing new street lighting and converting existing street lighting to LED.

 

                     SECTION 2.  That a portion of Sylvania Avenue between Douglas and Secor is specifically benefited by said improvements and abutting lots and lands shall be assessed at the rate per assessed front foot representing that part of the cost of lighting of said street or portion of said streets.

 

                     SECTION 3.  That the assessments so to be levied and assessed shall be levied and assessed annually in accordance with the assessing Ordinance hereafter to be passed by the Council and shall be certified to the County Auditor to be placed upon the tax duplicate and collected as other taxes.

 

                     SECTION 4.  That the remainder of the cost and expense of said improvement, not specially assessed, together with damages, if any, awarded to the owner of adjoining lands, with interest thereon, and the costs and expenses of any such award, shall be paid by a levy upon the general tax list made by the City for such purpose in the manner provided by law.

 

                     SECTION 5.  That notice of the adoption of this Resolution shall be by publication in the Toledo City Journal in the manner provided by law.

                                                                                    

                     SECTION 6.  That this Resolution is declared to be an emergency measure and shall take effect and be in force from and after its passage. The reason for the emergency lies in the fact that the same is necessary for the immediate preservation of the public peace, health, safety and property and so that this project can be initiated as soon as possible for lighting enhancement.
