SUMMARY & BACKGROUND:
A sewer main (Sewer No. CO16) collapse in the sidewalk near 2301 W. Bancroft occurred in March 2019. Due to the excessive number of utilities (Large water main, traffic conduit, gas main and old street sign concrete base), and to assure the safety of the citizens, Department of Public Utilities (DPU) required the expertise and equipment available through a private contractor to complete repairs in March 2019. TMC Section 187 requires City Council to be informed of the emergency and for authorization to pay the repair and waiving the competitive bidding. Sufficient funds are available within the DPU operating budget to pay for this emergency sanitary sewer repair.

Summary
NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:
SECTION 1. That the sum of $46,509 is authorized for expenditure from the Sanitary Sewer Operating Fund, Account Code 6070-37000-4000558STDSTD, to R&S Construction for payment of the emergency repair at 2301 W Bancroft.

SECTION 2. That Council finds that it is in the best interest of the City that the competitive procurement requirements of Chapter 187 of the Toledo Municipal Code are waived for the reason that emergency repairs are needed to maintain uninterrupted utility services and for the further reason that repair cost has been deemed reasonable by the Director of Public Utilities.
