SUMMARY & BACKGROUND:
The city has received numerous complaints regarding the absence of lighting on Collingwood Avenue, between Nesslewood Avenue to Winthrop Street. This legislation proposes to install twenty-one (21) street lights to better illuminate this area.
The annual cost of this improvement is $5,154 along with a one-time installation cost of $42,337 which will be paid from the General Fund utilities account in which this expense has been included in the 2019 annual budget.
Summary
NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:
SECTION 1. That it is determined to proceed with the improvement of the following lots and lands by installing street lighting, as described below, pursuant to the authority cited below and in accordance with Resolution No. 109-19, adopted on March 5, 2019, and in accordance with plans, specifications, and estimates heretofore approved and on file in the Division of Engineering Services.
A. Collingwood Avenue, between Nesslewood Avenue and Winthrop Street by installing twenty-one (21) 50 watt LED Acorn Style streetlights on fiberglass poles with underground service in accordance with plans, specifications, and estimates heretofore approved and on file in the Division of Engineering Services.
SECTION 2. That the plans, specifications and estimates for this proposed improvement are approved and will be filed at the Division of Engineering Services Street Lighting Section.
SECTION 3. That the annual cost and expense of said improvement, together with damages, if any, awarded to the owner of adjoining lands, with interest thereon, and the costs and expenses of any such award, shall be paid from the General Fund, Account Code 1001-11200-2424004STDSTD, by the city in a manner provided by law.
SECTION 4. That the Toledo Edison Company is authorized and directed to accomplish the improvements described in Section 1 hereof; such lights to be erected and maintained, and payment therefore to be made in accordance with the applicable terms and provisions of the Toledo Edison street lighting tariff as approved by the Public Utilities Commission of Ohio.
SECTION 5. That the Clerk of Council be and he is directed to furnish said Toledo Edison Company with a certified copy and written notice of the passage of the ordinance after publication of the same.
SECTION 6. That this ordinance is declared to be an emergency measure and shall be in force and effect from and after its passage. The reason for the emergency lies in the fact that the same is necessary for the immediate preservation of the public peace, health, safety, and property and for the further reason that this ordinance must be immediately effective in order to expedite the installation of street lighting.
