Approving inclusion of certain land situated in the City of Toledo, Ohio owned by Bruce and Ann Brodbeck into an Agricultural District for a five-year period; and declaring an emergency.

SUMMARY & BACKGROUND:
Bruce and Ann Brodbeck has filed a renewal application for the placement of farmland in an Agricultural District as provided by the Ohio Revised Code 929.02.

Summary
NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:

SECTION 1. That it is determined that the land described below owned by Bruce and Ann Brodbeck, for 3 years prior to 2019 has been devoted exclusively to agricultural production, as defined by Section 929.01 et seq. of the Ohio Revised Code; that the requirements of said section have been established; and that the application referred to above should be and hereby is approved.

SECTION 2. That parcel numbers 2007017, 2007704, 2007501, 2015271, 2015351, 2005431 and 2015261 all located at 702 Wenz Rd are located within the City of Toledo, Lucas County, owned by Bruce and Ann Brodbeck as set forth in the application referred to above is placed in an Agricultural District for the purposes of collection of future assessments as defined by said sections of the Ohio Revised Code.

SECTION 3. That the Clerk is hereby authorized and directed to forward a certified copy of this Ordinance to the applicants and the Auditor, Lucas County Ohio.

SECTION 4. That it is hereby found and determined that all formal actions of this Council concerning and related to the passage of this Ordinance were adopted in an open meeting of this Council and that all deliberations of this Council and any of its Committees that resulted in such formal actions were in meetings open to the public in compliance with all legal requirements including section 121.22 of the Ohio Revised Code and that the reading and adoption of this ordinance complies with the provisions of the Charter.
