Title

Authorizing the mayor to renew contracts with Taylor Excavating in the amount of $1,250,000 for the purpose of providing water and sanitary sewer kills for the City of Toledo, Lucas County Land Reutilization Corporation, and private demolition projects; authorizing the expenditure from the Water Operating Fund, the Sewer Operating Fund, and the Expendable Trust Fund; and declaring an emergency.

SUMMARY & BACKGROUND:

In compliance with Toledo Municipal Code (TMC) Section 927.13 and Section 107.03; whenever a building is demolished, sewer and water is taken out of service, the connection to the public sewer and water services shall be plugged (killed) at the tapping or opening into the public sewer/water main.  To execute this process, the Division of Sewer and Drainage Services bid out and awarded price determining contracts with the lowest bidder, Taylor Excavating, as authorized under Ordinance 95-18, to perform sewer and water service kills for the City of Toledo, Lucas County Land Reutilization Corporation, and private demolition projects through utilization of the Water Operating Fund, Sanitary Sewer Fund, and Expendable Trust Fund.  In order to maintain 2018 pricing, Taylor Excavating and Sewer and Drainage Services desire the renewal of the existing contract for Sewer and Water Kills. There is no additional financial impact to the City of Toledo as these funds were budgeted for the 2019 budget.

 

Summary

NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:

 

                     SECTION 1. That the mayor is authorized to execute necessary renewal contracts, in accordance with the purchasing policies and procedures of the city, for one (1) year with Taylor Excavating Inc., for the purposes listed in Sections 1 and 2, upon such terms and conditions shall be approved by the mayor, the Director of Public Utilities and the Director of Law. 

 

                     SECTION 2. That an expenditure is authorized in an amount not to exceed $162,000 from the Water Operating Fund, Account Code 6060-37000-4000512WTRKIL for city water kills and expenditures are authorized in amounts not to exceed $146,000 from the Sewer Operating Fund for Account Code 6070-37000-4000558STDSTD for city sewer kills and expenditure is authorized in an amount not to exceed $142,000 from the Sewer Operating Fund in Account Code 6070-37000-4651006SWRKIL for private sewer kills.

 

                     SECTION 3. That an expenditure in an amount not to exceed the $800,000 from the Expendable Trust Fund, Account Code 2090-23100-5T12211STDDEM for water and sanitary sewer kills related to Lucas County Land Reutilization Corporation projects.

 

 

SECTION 4.  That the Finance Director is authorized to issue his warrant or warrants against the above mentioned account codes in amounts not to exceed those authorized above in payment of the above authorized obligations upon presentation of the proper voucher or vouchers.

 

                     SECTION 5.  That this ordinance is declared to be an emergency measure and shall be in force and effect from and after its passage.  The reason for the emergency lies in the fact that this ordinance is necessary for the immediate preservation of the public peace, health, safety, and property and for the further reason that this ordinance must be immediately effective in order to allow for the timely demolition of structures and buildings.
