SUMMARY & BACKGROUND:

The Division of Streets, Bridges & Harbor (SB&H) is partnered with the Lucas County Land Bank to perform housing demolition within the City of Toledo. During the summer, when demolition is most active, both in-house excavators went out-of-service with extensive repairs needed. While bids and contracts took place, it became necessary to rent an excavator to continue on schedule with the Land Bank program and to have in the event crews were required to assist with emergency fire demolitions. Ohio CAT, located in Perrysburg, was the only supplier of an excavator equipped for demolition operations when acquiring rental pricing.  Currently, the Division has both excavators back in service and a new smaller excavator has been purchased.

 

Summary

NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:

 

SECTION 1.  That an amount not to exceed $20,000 is authorized for expenditure from the Demolition Trust Fund, Account Code 2090-23100-5T12211STDDEM for payment of one (1) rental excavator from Ohio CAT.

 

SECTION 2.  That the competitive bidding requirements of TMC Chapter 187 are waived due to both in-house excavators being out-of-service with extensive repairs, and Ohio CAT being the only supplier of an excavator equipped for demolition operations.

 

SECTION 3. That the Mayor is authorized to enter into a contract with Ohio CAT for excavator rental, subject to terms and conditions as approved by the Directors of Law and Public Service.

 

SECTION 4.  That the Finance Director is authorized to draw warrant or warrants against the account codes upon presentation of properly approved voucher or vouchers in a total amount not to exceed $20,000.

 

SECTION 5.  That this Ordinance, being an emergency measure, shall take effect and be in force from and after its passage.  The reason for the emergency lies in the fact that it is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that the Ordinance must be immediately effective in order to ensure that an excavator was available in-house to utilize for emergency fire demolitions and to continue on schedule with the Land Bank demolition program.
