SUMMARY & BACKGROUND:

The City of Toledo is entering into a grant agreement with Ohio EPA for an Implementing Ohio’s Domestic Action Workplan subgrant in the amount of $179,400 to be used for the Delaware Creek Restoration Project.  In addition to the subgrant, match funds in the amount of $119,600 will be utilized from the Stormwater Utility Improvement Fund.

 

Summary

NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:

 

                     SECTION 1.   That the mayor is authorized to enter into a grant agreement with the Ohio Environmental Protection Agency for the State of Ohio’s DAP Grant Program, upon terms acceptable to the Director of Public Utilities and the Director of Law.

 

SECTION 2.   That the mayor is authorized to accept and deposit grant proceeds in an amount not to exceed $179,400 into the Operation Grants Fund Account Code 2016-38000-4UG2118STDSTD for the Delaware Creek Restoration Project.

 

SECTION 3. That the appropriation of $179,400 is authorized from the unappropriated grant proceeds of the Operation Grant Fund to Account Code 2016-38000-4UG2118STDSTD and the expenditure of same is authorized for the Delaware Creek Restoration Project.

                     

                     SECTION 4.  That the appropriation of $119,600 is authorized from the Stormwater Utility Improvement Fund to Account Code 607B-38000-4UC2118STDSTD and the expenditure of same is authorized for the Delaware Creek Restoration Project. 

 

                     SECTION 5.  That the mayor is authorized to accept bids and execute necessary contracts for the purchase of services and other necessary items to complete the Delaware Creek Restoration Project upon such terms and conditions as shall be approved by the Director of Public Utilities and the Director of Law.

 

SECTION 6.   That the disappropriation of any remaining budget to fund balance at project closeout is authorized. 

                     

SECTION 7.                     That the Finance Director is authorized to issue his warrant or warrants against the account codes above in amounts not to exceed those authorized above in payment of the obligations incurred pursuant to the above-authorized contracts upon presentation of proper voucher or vouchers.  

 

SECTION 8.                     That this ordinance is declared to be an emergency and shall be in force and effect from and after its passage. The reason for the emergency lies in the fact that this ordinance is necessary for the immediate preservation of the public peace, health, safety and property of the city and for the further reason that this ordinance must be immediately effective in order to implement this program within the Ohio Environmental Protection Agency’s designated shortened time schedule.
