Body

SUMMARY & BACKGROUND:

The Toledo Municipal Code Part Thirteen - Building Code, Chapter 1307 (Fees), specifies the permit fees for: building, electrical, plumbing, HVAC, hydronic, refrigeration and also for licensing, plan review, inspections and administrative services. This ordinance simplifies and streamlines permits. The ordinance also raises the charges for some of the permit fees and associated services. Permit fees have remained at the same level since May of 2015. Contractor and construction trade registration and renewal fees remain unchanged under this proposed ordinance.

 

Summary

NOW, THEREFORE, Be it ordained by the Council of the City of Toledo,

 

SECTION 1.   That existing Toledo Municipal Code §1307 Fees, which reads as follows:

1307.01. General.

   Upon the filing of an application for a permit required pursuant to the provisions of this Part Thirteen-Building Code the applicant shall pay the fee as hereinafter set forth.  (See Section 1305.02 for permits not required.)

1307.02. Permit fees for buildings and structures.

   In addition to the permit fees listed below, a Certificate of Zoning Compliance shall be required for all new construction of buildings or structures and/or new additions to existing buildings and structures regulated by the Ohio Building Code and/or the Residential Code of Ohio.  A Certificate of Zoning Compliance shall also be required for all residential and commercial accessory structures, ramps, decks, regardless of size, for all fences regardless of height, and all pools greater than 24" in depth.

   (a)   Residential 1, 2, or 3 family dwellings - new construction, additions, structural alterations.

      Base fee   $60.00

1307.07. Administrative fees.

   (a)   When the application for a permit has been properly completed, accepted by the Division of Building Inspection, all required fees have been paid, and the project or improvement is then canceled by the contractor and/or property owner, then there shall be no refund of the permit fee.

   (b)   When a project is canceled and a new permit for the same project is secured by another contractor or a property owner, the contractor securing the original permit which was canceled shall be entitled to a refund of the permit fee minus a twenty-five dollar ($25.00) processing fee.

   (c)   Applicants for examinations and/or registrations under this chapter who are not accepted as qualified applicants shall be entitled to a refund of the application fee minus a twenty-five dollar ($25.00) processing fee.

1307.08. Fees for reviewing plans; early start authorization.

   (a)   Plans submitted for examination under the Ohio Building Code or its associated mechanical and electrical codes.

      (1)   Structural plan examination: $75.00 base fee; plus $.03 (cents) per square foot (100 sf min.)

      (2)   Non-structural plan examination: $50.00 base fee; plus $.03 (cents) per square foot (100 sf min.)

      (3)   Resubmissions.  The fees set forth in sections 1307.08(a) shall include one (1) initial plan review and up to one (1) resubmission plan review to resolve issues resulting from adjudication letters.  The fee for plan review after the first (1st)  resubmission shall be one hundred dollars ($100.00) for each additional resubmission.

      (4)   Amended construction documents, after initial plan approval: $75.00 per submission

      (5)   Phased plan approval, after initial plan approval: $75.00 per phase submission; plus $.03 (cents) per square foot (100 sf min.)

   (b)   Plans submitted for examination under the Residential Code of Ohio.

      (1)   Residential plan examination: $50.00 base fee; plus $.03 (cents) per square foot (100 sf min.)

      (2)   Residential resubmissions.  The fees set forth in sections 1307.08(b) shall include one initial plan review and up to two resubmission plan reviews to resolve issues resulting from correction letters.  The fee for plan review after the second resubmission shall be fifty dollars ($50.00) for each additional resubmission.

      (3)   Amended construction documents: $35.00 per submission.

   (c)   Early start authorization.

      (1)   Persons applying for permits for interior alterations which do not involve structural changes may apply for an early start authorization.  Construction work under an early start authorization is limited to work up to the rough-in-stage and no work may be concealed.

      (2)   Issuance of an early start authorization allows work to commence while plans are being reviewed prior to permit issuance.  Inspections will not be made for any work performed under an early start authorization until permits for the work are issued.

      (3)   All work done under an early start authorization will be performed at the applicant's risk.  The Division of Building Inspection is under no obligation to approve work performed under an early start authorization not conforming to the applicable codes.  The Division of Building Inspection may order removal of some or all work performed under an early start authorization not conforming to the applicable codes.  The Division of Building Inspection or City of Toledo shall not be held liable for any damages associated with issuance of an early start authorization, wherein work does not conform to the applicable codes.

      (4)   Early start authorization fees:

         Building permits - one half of one percent (.005) of the building permit valuation (minimum $75.00).

         Electrical, plumbing, heating, cooling and refrigeration permits: $75.00 each

      (5)   Early start authorization shall expire upon issuance of a permit for the work or ninety days after issuance, whichever is first.

1307.09. Investigation of illegal or unauthorized work.

   See Chapter 1319.

1307.10. Reinspection.

   When additional inspections or extra trips, over and above those established by the Division of Building Inspection are made necessary by incomplete or faulty work, or because of incorrect address supplied, or failure of the permit holder or permit holder's agent to keep appointments, or for other similar reasons, a fee of seventy-five dollars ($75.00) per hour or fraction thereof shall be charged for each additional reinspection required, which fees shall be paid by the holder of the permits.

1307.11. Special inspections or services.

   Any person, firm or corporation requesting an inspection of any existing building or part thereof, or other special services of whatever nature, shall be charged a fee for such special inspection or special service on the basis of time consumed by each inspector or authorized person performing the services, at the rate of seventy-five dollars ($75.00) for each hour or fraction thereof.

1307.12. Swimming pools.

   A Certificate of Zoning Compliance shall be required for all above-ground and in-ground residential pools deeper than 24".

   (a)   Above-ground, residential pool - Certificate of Zoning Compliance

   (c)   Commercial in-ground (public licensed) pool - (See Section 1727.06 for structural criteria)

1307.13.  State of Ohio fees.

   In addition to the fees stated in this chapter, when a permit is subject to Ohio Building Code or the Residential Code of Ohio requirements, each permit applicant shall also be charged an additional surcharge fee imposed by the State of Ohio.

1307.03. Plan Review & Early Start Phased Permit Fees

 (A.)   Plans submitted for examination under the Ohio Building Code or its associated mechanical and electrical codes.

                            1.    Plan Examination: $75.00 base fee; plus $.03 (cents) per square foot (100 sf min.)

2.    Resubmissions.  The fees set forth in sections 1307.08(a) shall include one (1) initial plan review and one (1) resubmission plan review to resolve issues resulting from correction letters. The fee for plan review after the first (1st) resubmission shall be one hundred fifty dollars ($150.00) and three hundred dollars ($300.00) for each additional resubmission.

       3. Amended construction documents, after initial plan approval: $100.00 per submission

       4. Phased plan approval, after initial plan approval: $100.00 per phase submission; plus $.03   (cents) per square foot (100 sf min.)

  (B.)   Plans submitted for examination under the Residential Code of Ohio.

1.                     Residential plan examination: $50.00 base fee; plus $.03 (cents) per square foot (100 sf    min.)

2.      Residential resubmissions.  The fees set forth in sections 1307.08(b) shall include one initial plan review and one resubmission plan review to resolve issues resulting from correction letters.  The fee for plan review after the first (1st) resubmission shall be  seventy - five dollars (75.00) and for each additional resubmission.

3.                          Amended construction documents: $50.00 per submission.

 

 (C.)   Early Start Phased Permit (ESPP)

   1.   Persons applying for permits for interior alterations which do not involve structural     changes may apply for an Early Start Phased Permit (ESPP). Construction work under an ESPP is limited to work up to the rough-in-stage and no work may be concealed.

2.   Issuance of an ESPP allows work to commence while plans are being reviewed prior to permit issuance. Inspections will not be made for any work performed under an ESPP until permits for the work are issued.

3.   All work done under an ESPP will be performed at the applicant's risk. The Division of Building Inspection is under no obligation to approve work performed under an ESPP not conforming to the applicable codes.  The Division of Building Inspection may order removal of some or all work performed under an ESPP not conforming to the applicable codes.  The Division of Building Inspection or City of Toledo shall not be held liable for any damages associated with issuance of an ESPP, wherein work does not conform to the applicable codes.

4.   Early Start Phased Permit (ESPP) fees:

                                   a. Building permits - one half of one percent (.005) of the building permit valuation

                         (minimum $100.00)

                     b. Electrical, Plumbing, HVAC, Hydronic, or Refrigeration & pressure piping permits;

5.   Early Start Phased Permits (ESPP) shall expire upon issuance of a permit for the work or ninety days after issuance, whichever is first.

                     6.   Release of electrical services.

                  Note: Fees for multi- residential occupancy shall be based on total amp capacity per unit.

1307.08. Administrative fees.  

(A.)   When the application for a permit has been properly completed, accepted by the Division of Building Inspection, all required fees have been paid, and the project or improvement is then canceled by the contractor and/or property owner, then there shall be no refund of the permit fee.

(B.)   When a project is canceled and a new permit for the same project is secured by another contractor or a   property owner, the contractor securing the original permit which was canceled shall be entitled to a refund of the permit fee minus a fifty-dollar ($50.00) processing fee.

(C.)   Applicants for examinations and/or registrations under this chapter who are not accepted as qualified applicants shall be entitled to a refund of the application fee minus a twenty-five dollar ($25.00) processing fee.

 

1307.09. Investigation of illegal or unauthorized work.

   See Chapter 1319.

 

1307.10. Re-inspection.

When additional inspections or extra trips, over and above those established by the Division of Building Inspection are made necessary by incomplete or faulty work, or because of incorrect address supplied, or failure of the permit holder or permit holder's agent to keep appointments, or for other similar reasons, a fee of one hundred dollars ($100.00) per hour or fraction thereof shall be charged for each additional reinspection required, which fees shall be paid by the holder of the permits.

 

1307.11. Special inspections or services.

Any person, firm or corporation requesting an inspection of any existing building or part thereof, or other special services of whatever nature, shall be charged a fee for such special inspection or special service on the basis of time consumed by each inspector or authorized person performing the services, at the rate of seventy-five dollars ($75.00) for each hour or fraction thereof. Minimum fee of two 2 hours.

 

1307.12. Swimming pools.

A Certificate of Zoning Compliance shall be required for all above-ground and in-ground residential pools deeper than 24".

1307.13.  State of Ohio fees.

In addition to the fees stated in this chapter, when a permit is subject to Ohio Building Code or the   Residential Code of Ohio requirements, each permit applicant shall also be charged an additional surcharge fee imposed by the State of Ohio.

A.                     Residential (all permits for 1, 2, or 3 family dwellings & accessory structures) plus 1% of total

B.                     Commercial (all permits other than residential) plus 3% of total

 

1307.14   Business Fees

    (A.)  Mailing fees: 8.5x11inch, 11x17inch, or smaller ($5.00)

     (B.)  Copy or printing fees: 8.5x11inch or 11x17inch ($2.00 per sheet)

 

 

SECTION 3.  That this Ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage, beginning January 1, 2019. The reason for the emergency lies in the fact that same is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that this legislation is needed to correct and reconcile provisions of the code.
