Title
Authorizing the mayor to enter into sanitary sewer repair contracts and to execute all documents necessary and proper to facilitate sanitary sewer repairs in Sewer Repair District 3 (South), within the public rights-of-way and/or public sanitary sewer easements; authorizing the expenditure of an amount not to exceed $1,282,350 from the Sanitary Sewer Operating Fund; and declaring an emergency.

SUMMARY & BACKGROUND:
This ordinance authorizes a contract for the performance of sanitary sewer repairs in Sewer Repair District 3 (South) within the public rights-of-way and/or public sanitary sewer easements beyond the scope of what the in-house crews are capable of performing. The only bid received was within the engineering estimate. Funds have been identified in the 2018 operating budget to pay the anticipated cost of said sanitary sewer repairs.
Summary
NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:
SECTION 1. That the mayor is authorized to enter into a one (1) year contract with two (2) one (1) year extension options and to execute all documents necessary and proper to facilitate sanitary sewer repairs in Sewer Repair District 3 (South) (within the public rights-of-way and/or public sanitary sewer easements) upon such terms and conditions shall be approved by the Director of Public Utilities and the Director of Law.
SECTION 2. That an expenditure in an amount not to exceed $1,282,350 annually from the Sanitary Sewer Operating Fund, account code 6070-37000-4000509STDSTD is authorized for sanitary sewer repairs in Sewer Repair District 3 (South) within the public rights-of-way and/or public sanitary sewer easements, subject to the availability of funds in future years.
SECTION 3. That the Finance Director is authorized to issue her warrant or warrants against the account code identified in Section 2 above in an amount not to exceed $1,282,350 annually in payment of the obligations incurred pursuant to the contract authorized in Section 1 upon presentation of the proper voucher or vouchers.
SECTION 4. That this ordinance is declared to be an emergency measure and shall be in force and effect from and after its passage. The reason for the emergency lies in the fact that this ordinance is necessary for the immediate preservation of the public peace, health, safety, and property and for the further reason that this ordinance must be immediately effective in order to allow for the timely repairs of the sanitary sewers in Sewer Repair District 3 (South) within the public rights-of-way and/or public sanitary sewer easements.
