Title
Authorizing the mayor to enter into an agreement with PFM Solutions LLC. for the use of the Whitebirch™ Service Software and the Whitebirch Financial Modeling Platform in the Division of Utilities Administration for a period up to three years; waiving competitive bid requirements of TMC Chapter 187; authorizing the appropriation of $52,084 from the Water Replacement Fund and $52,084 from the Sewer Replacement Fund; authorizing the operating transfer of said funds to the Water Operating Fund and Sewer Operating Fund; authorizing the appropriation and expenditure of $52,084 in the Water Operating Fund for Whitebirch implementation and subscription fees; authorizing the appropriation and expenditure of $52,084 in the Sewer Operating Fund for Whitebirch implementation and subscription fees; authorizing the expenditure of $50,000 for the annual subscription fee, subject to future appropriation; and declaring an emergency.

SUMMARY & BACKGROUND:
The Division of Utilities Administration currently utilizes a program now called FuturePerfect for financial modeling. The cloud-based Whitebirch system would replace FuturePerfect and PFM would apply any unused subscription fee towards the use of Whitebirch. This form of financial modeling platform helps to design, build, manage, and validate projections with use of different scenarios. In the future Water and Sewer Operating Budgets, $50,000 would be included for the annual access fee.
Summary
NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:
SECTION 1. That the mayor is authorized to enter into an agreement with PFM Solutions, LLC. through 2020 for the implementation of and subscription to the Whitebirch™ Service Software and the Whitebirch Financial Modeling Platform in the Division of Utilities Administration.
SECTION 2. That the competitive bid requirements of TMC Chapter 187 are waived for the reason that the department of public utilities is currently using PFM software and the new platform will allow the department to meet time constraints related to regional water.
SECTION 3. That the appropriation of $52,084 is authorized from the unappropriated balance of the Water Replacement Fund to Account Code 6063-31000-558100-4000511STDSTD and the appropriation of $52,084 is authorized from the unappropriated balance of the Sewer Replacement Fund to Account Code 6073-31000-558100-4000508STDSTD.
SECTION 4. That the operating transfer of $52,084 is authorized from the Water Replacement Fund to the Water Operating Fund Account Code 6060-31000-408690-4000511STDSTD and the operating transfer of $52,084 is authorized from the Sewer Replacement Fund to the Sewer Operating Fund Account Code 6070-31000-408690-4000508STDSTD.
SECTION 5. That the appropriation in an amount not to exceed $52,084 is authorized in the Water Operating Fund to account code 6060-31000-4000511STDSTD for implementation and subscription fees for the use of the Whitebirch™ Service Software and the Whitebirch Financial Modeling Platform and authorizing expenditure of same.
SECTION 6. That the appropriation in an amount not to exceed $52,084 is authorized in the Sewer Operating Fund to account code 6070-31000-4000508STDSTD for implementation and subscription fees for the use Whitebirch™ Service Software and the Whitebirch Financial Modeling Platform and authorizing expenditure of same.
SECTION 7. That the expenditure of $50,000 annually is authorized for payment of annual subscription fees incurred pursuant to Section 1, subject to future appropriations.
SECTION 8. That the Director of Finance is authorized to issue warrant or warrants against the above listed account codes in an amount not to exceed that authorized above in payment of the obligations incurred pursuant to the agreements authorized in Section 1 upon presentation of proper voucher or vouchers.
SECTION 9. That this ordinance is declared to be an emergency measure and shall take effect and be in force immediately from and after its passage. The reason for the emergency lies in the fact that this ordinance is necessary for the immediate preservation of the public peace, health, safety and property.
