Title

Authorizing the Mayor to execute and deliver needed instruments for the partial release of the Front Street right-of-way in the vicinity of Randolph Street in the City of Toledo, Lucas County, Ohio, for the purpose of facilitating redevelopment of the Ironville Terminal; and declaring an emergency.

SUMMARY & BACKGROUND:

This ordinance authorizes the release of a 1.522 acre portion of the Front Street right-of-way held by easement in favor of the City of Toledo. This release will facilitate the redevelopment of the Ironville Terminal in east Toledo by the construction and operation of the area’s first hot briquetted iron (HBI) production plant. This HBI project has the potential to create to 130 permanent jobs, more than 1,200 construction jobs, and represents a 700 million dollar investment in the Toledo region. This HBI project is made possible due to partnerships between the Port Authority, Jobs Ohio, Midwest Terminals of Toledo, City of Toledo, Lucas County, the Regional Growth Partnership, and the Ohio Rail Development Commission. 

 

Summary

NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:

 

                     SECTION 1. That the Mayor is authorized to execute and deliver needed instruments for the partial release of a 1.522 acre portion of the Front Street right-of-way as described on Exhibit “A” attached, upon such terms and conditions as approved by the Director of Business & Economic Development, Director of Public Utilities, and the Director of Law.

 

                     SECTION 2.  That it is found and determined that all formal actions of Council concerning and relating to the passage of this Ordinance were adopted in an open meeting of Council and that all deliberations of Council and any of its committees that result in such formal actions were in meetings open to the public in compliance with all legal requirements, including Section 121.22, of the Ohio Revised Code.

 

                     SECTION 3.  That this Ordinance is hereby declared to be an emergency measure and shall take effect and be in force immediately from and after its passage. The reason for the emergency lies in the fact that same is necessary for the immediate preservation of public property, and for the further reason that this Ordinance must be immediately effective to timely facilitate the redevelopment of the Ironville Terminate site.
