SUMMARY & BACKGROUND:

The City of Toledo is the owner of certain real property located in Monclova Township known as Triad Business Park (TD 38-000694). The subject property was split in such a way to facilitate the parcel being publically dedicated as right-of-way known as Riverfort Drive.  The City intends to work with the Board of Commissioners of Lucas County to dedicate the real property identified in Exhibit A, attached to and made part of this ordinance. The dedication of Riverfort Drive is necessary to facilitate future development within Triad Business Park. The subject property is located within the Maumee-Monclova-Toledo Joint Economic Development Zone.

 

Summary

NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:

 

                     SECTION 1.                     That the Mayor is authorized to execute and deliver the needed instruments for the public dedication of Riverfort Drive as right-of-way under additional terms and conditions approved by the Mayor, the Director of Law and the Director of Economic & Business Development as being in the best interests of this City, and in keeping with the findings, determinations and purposes of this Ordinance, with the execution by the Mayor of the needed instruments being conclusive evidence of such approvals, and no further action relating thereto shall be required by Council.

 

SECTION 2.                     That this Council finds and determines that the Real Property to be publically dedicated is Real Property which is not needed by the City for any municipal purpose; notwithstanding and as an exception to the notice, publication and bidding provisions of Chapter 187 of the Toledo Municipal Code and the same are waived; that the public dedication thereof by the Board of County Commissioners of Lucas County is necessary to create or preserve jobs and other employment opportunities in the region and to improve the economic welfare of the people of the City of Toledo and is in the best interests of the City and region.

 

SECTION 3. That it is found and determined that all formal actions of Council concerning and relating to the passage of this Ordinance were adopted in an open meeting of Council and that all deliberations of Council and any of its committees that result in such formal action were in meetings open to the public in compliance with all legal requirements, including Section 121.22 Ohio Revised Code.

 

SECTION 4.                     That this Ordinance is declared to be an emergency measure and shall take effect and be in force immediately from and after its passage.  The reason for the emergency lies in the fact that the same is necessary for the immediate preservation of the public peace, health, safety and property and for the further reason that this Ordinance must be immediately effective in order to effectuate the dedication of this right-of-way at the earliest possible date.
