SUMMARY & BACKGROUND:

Ordinance 345-16, passed September 27, 2016, established the Downtown Outdoor Refreshment Area. This ordinance incorporated the approval of a public health and safety plan that included (1) the number, spacing, and type of signage designating the area, (2) the hours of operation for the area, (3) the number of personnel needed to ensure public safety in the area, (4) the sanitation plan that will help maintain the appearance and public health of the area, and (5) the number of personnel needed to execute the sanitation plan. In the anticipation to the Downtown Outdoor Refreshment Area’s launch date of June 15, 2017, the participating liquor permit premises, in conjunction with the Toledo Regional Chamber of Commerce, the Downtown Toledo Improvement District, and Destination Toledo, determined that the hours of operation should be modified, and Ordinance 206-17 was passed on May 16, 2017 to mandate the current hours of operation. The current hours of operation are 12:00 p.m. to 12:00 a.m. Sunday through Saturday. The participating liquor permit premises have requested the hours of operation of the Downtown Open Refreshment Area be extended for the benefit of the City’s nightlife and entertainment industry and to promote further economic development in downtown Toledo. Toledo City Council has determined that no public safety concerns have arisen within the Downtown Outdoor Refreshment Area since its inception. Therefore, the proposed new hours of operation are 12:00 p.m. to 1:00 a.m., seven (7) days a week, subject to more restrictive hours as determined by the Chief of Police.

 

Summary

NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:

 

                             SECTION 1.   That hours of operation for the Downtown Outdoor Refreshment Area are established as follows:

 

                                                                      12:00 p.m. to 1:00 a.m. Sunday through Saturday

 

The Chief of Police shall have authority to temporarily restrict the hours of operation from time-to-time if the Chief of Police determines that restrictions are in the interest of public safety.

 

                             SECTION 2.   That it is found and determined by Council of the City of Toledo that the above referenced changes to the hours of operation are for the purpose of ensuring public health and safety within the area and for the benefit of the City’s nightlife and economic development downtown.

 

                             SECTION 3.   That the Clerk of Council is instructed to forthwith serve a copy of this ordinance upon the Superintendent of the Ohio Department of Commerce, Division of Liquor Control.

 

                             SECTION 4.  That this Ordinance is declared to be an emergency measure and shall be in force and effect from and after its passage. The reason for the emergency lies in the fact that the same is necessary for the immediate preservation of public peace, health, safety, and property and for further reason that this ordinance must be immediately effective in order to facilitate the establishment and operation of the Downtown Outdoor Refreshment Area.
