SUMMARY & BACKGROUND:

The utilization and maintenance of Joe E. Brown Park is a matter of great concern.  It is important that citizens become involved and participate in decisions affecting how Joe E. Brown Park is operated.  The passage of this Ordinance will establish the Joe E. Brown Park Advisory Board to assist the City of Toledo and the Division of Parks, Recreation & Forestry in operating the park in a competent manner and create the Joe E. Brown Park Trust Fund.

 

Summary

NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:

 

                     SECTION 1.  That Title Seven of Part One of the Toledo Municipal Code is amended and supplemented by enacting a new Chapter 162 to read as follows:

 

Chapter 162

Joe E. Brown Park Advisory Board

 

                     162.01  Board created.

                     There is hereby created the Joe E. Brown Park Advisory Board, which shall consist of not less than five (5) nor more than fifteen (15) members who shall serve without compensation. 

 

                     162.02  Membership.

The members of the Joe E. Brown Park Advisory Board shall be nominated by the Mayor, subject to the confirmation by a majority vote of the City Council, and all of the members shall have voting power.

 

                     162.03  Terms of members.

                     All appointments shall be for a four-year term, or for unexpired vacancies that may occur.  Any member may be re-appointed by the Mayor to serve additional terms, subject to the approval by Council. Unless specifically excused by City Council, all Board members shall be residents of the City of Toledo during the entire term of their appointment. Except as provided in Section 141.01 of the Toledo Municipal Code, there is no limit as to the number of terms any Board member may serve.

 

                     162.04  Duties of the Board. 

                     The Board shall advise on the operation and maintenance of Joe E. Brown Park and will serve in an advisory capacity to the Mayor, City Council and Division of Parks, Recreation & Forestry.  The Board shall render periodic reports and recommendations to the Commissioner of the Division of Parks, Recreation & Forestry.  The Board shall, when requested by Council, consider, investigate, make findings, report and recommend upon any special matter or questions coming within the scope of this work.

 

                     162.05  Organization and meetings.

The Board shall elect its own President and such other officers as it deems necessary. The Board may create from its members and/or persons who are not members, associate memberships and such committees and subcommittees as it shall deem necessary to carry out the function of the Board. It shall prescribe its own rules of procedure and shall keep a record of its transactions and report annually to the Mayor and Council. It shall meet not less than once each month. The Commissioner of Parks, Recreation and Forestry or his designated representative shall serve as an ex-officio member of the Board.

 

162.06  Donations and gifts.

   The Joe E. Brown Park Advisory Board is hereby authorized to accept donations and gifts for the express purpose of defraying the costs incurred in its operations and duties. Any donations and gifts so received are to be deposited in the Joe E. Brown Trust Fund Account Code 2151-60500-7T71520STDSTD which is hereby established to serve as a depository for all funds received and said amounts shall be deemed appropriated for proper expenditure. Disbursement shall be made from such trust fund by the Director of Finance upon presentation of proper vouchers from the Joe E. Brown Park Advisory Board and approved by the Division of Parks, Recreation and Forestry.

 

                     SECTION 2.  That this Ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage.  The reason for this emergency lies in the fact that this Ordinance is necessary for the immediate preservation of the public peace, healthy, safety and property and for the further reason in order to obtain citizens’ participation toward the goal of operating and maintaining Joe E. Brown Park in a quality manner.
