Title
Authorizing the appropriation and operating transfer of $670,000 from the unappropriated balance of the Demolition Trust Fund into the Water Operating Fund in the amount of $536,000 and into the Sewer Operating Fund in amount of $134,000; authorizing the Mayor to renew contracts with Taylor Excavating for the purpose of providing water and sanitary sewer kills for the City of Toledo, Lucas County Land Reutilization Corporation, and private demolition projects; authorizing the expenditure in an amount not to exceed $782,203 from the Water Operating Fund and an amount not to exceed $249,800 from the Sewer Operating Fund; and declaring an emergency.

SUMMARY & BACKGROUND:
In compliance with Toledo Municipal Code (TMC) Section 927.13 and Section 107.03; whenever a building is demolished, sewer and water is taken out of service, the connection to the public sewer and water services shall be plugged (killed) at the tapping or opening into the public sewer/water main. To execute this process, the Division of Sewer and Drainage Services bid out and awarded price determining contracts with the lowest bidder, Taylor Excavating, as authorized under Ordinance 420-16, to perform sewer and water service kills for the City of Toledo, Lucas County Land Reutilization Corporation, and private demolition projects through utilization of the Water Operating Fund, Sanitary Sewer Fund, and Demolition Trust Fund. In order to maintain 2016 pricing, Taylor Excavating and Sewer and Drainage Services desire the renewal of the existing contract for Sewer and Water Kills. Sufficient funds have been provided in the proposed 2018 Operating Budget and Expendable Trust Fund. There is no additional financial impact to the City of Toledo as these funds were budgeted for the 2018 budget.
Summary
NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:
SECTION 1. That the sum of $670,000 is appropriated from the unappropriated balance of the Demolition Trust Fund into Account Code 2090-23100-5T12211STDDEM.
SECTION 2. That an operating transfer in the amount of $536,000 is authorized from the Demolition Trust Fund to the Water Operating Fund, Account Code 6060-37000-4000512STDSTD; and further authorizing an operating transfer in the amount of $134,000 to the Sewer Operating Fund, Account Code 6070-37000-4000509STDSTD.
SECTION 3. That the appropriation and expenditure is authorized from the Water Operating Fund, Account Code 6060-37000-4000512STDSTD in an amount not to exceed $648,576; and from the Sewer Operating Fund, Account Code 6070-37000-4000509STDSTD, in an amount not to exceed $216,000 for water and sanitary sewer kills for the Lucas County Land Reutilization Corporation projects and for City demolition projects.
SECTION 4. That an expenditure in an amount not to exceed $133,627 is authorized from the Water Operating Fund, Account Code 6060-37000-4000512STDSTD; and an expenditure in an amount not to exceed $33,800 is authorized from the Sewer Operating Fund, Account Code 6070-37000-4651006STDSTD, for water and sanitary sewer kills related to private demolition projects.
SECTION 5. That the Mayor is authorized to execute necessary renewal contracts, in accordance with the purchasing policies and procedures of the City, for one (1) year with Taylor Excavating Inc., for the purposes listed in Sections 3 and 4, upon such terms and conditions shall be approved by the Mayor, the Director of Public Utilities and the Director of Law.
SECTION 6. That the Finance Director is authorized to issue her warrant or warrants against the above mentioned Account Codes in an amount not to exceed $1,032,003 in payment of the above authorized obligations upon presentation of the proper voucher or vouchers.
SECTION 7. That this Ordinance is declared to be an emergency measure and shall be in force and effect from and after its passage. The reason for the emergency lies in the fact that this Ordinance is necessary for the immediate preservation of the public peace, health, safety, and property and for the further reason that this Ordinance must be immediately effective in order to allow for the timely demolition of structures and buildings.
