SUMMARY & BACKGROUND:
Donald McGranahan filed a lawsuit in the Lucas County Court of Common Pleas as a result of events which occurred on September 7, 2015. On that date officers were led to believe from a 911 call that they were responding to multiple on-going felonies that created a life-threatening situation. The Plaintiff was arrested and faced criminal charges before the case was dismissed.

A proposed agreement has been reached in the amount of $15,000 to settle all claims from the incident described herein without constituting an admission of liability for any violation of state or federal law.

Summary
NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:

SECTION 1. That payment of $15,000 in settlement of the claims against the City of Toledo and all of its individually named police officers is approved and the expenditure of same is authorized from the Risk Management Fund Account Code 7095-12000-1157001STDSTD.

SECTION 2. That the Director of Finance is authorized to draw his warrant or warrants to Donald McGranahan and his attorney Jerome Phillips in the sum of $15,000 against the above Account Code in payment of the above authorized obligations upon presentation of the proper vouchers.

SECTION 3. That this Ordinance being an emergency measure shall be in force and effect from and after its passage. The reason for the emergency lies in the fact that this ordinance is necessary for the immediate preservation of the public peace, health, safety and property and for the further reason that this ordinance must be immediately effective in order to ...
