SUMMARY & BACKGROUND:

In 2015, the City of Toledo successfully submitted an application to the U.S. EPA for a grant to establish a Brownfield Revolving Loan account.  Ordinance 267-16 authorized the Mayor to accept $820,000 from the U.S. EPA ($410,000 Hazardous Substance and $410,000 Petroleum Remediation) to loan and subgrant these funds for the purpose of environmental remediation at eligible Brownfield sites.

 

Authority for the grant to the Dental Center of Northwest Ohio is approved subject to approval by the U.S. EPA. The Dental Center of Northwest Ohio is a 501(c)(3) not-for-profit dental clinic providing oral health services for underserved children and adults with limited access to dental care.   

 

The City of Toledo desires at this time to use an amount not to exceed $200,000 as designated for Hazardous Substance Remediation for the purpose of asbestos and universal waste abatement at the Dental Center’s administrative offices and clinic located at 2100-2144 Madison Ave. in Toledo.  Once environmental cleanup is complete, the buildings will be demolished and a new dental clinic will be constructed.

 

This ordinance authorizes an expenditure from the Brownfield Revolving Loan account in the amount of $200,000. The current balance of Revolving Loan account is $820,000, of which $410,000 is available for hazardous substance remediation as authorized in this ordinance.   The allowed uses of this fund is asbestos abatement and universal waste disposal. There is no financial impact to the General Fund since this project is grant funded.

 

Summary

NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:

                     

                     SECTION 1.   That the Mayor is authorized to execute a subgrant agreement with the Dental Center of Northwest Ohio for the environmental cleanup of the property located at 2100-2144 Madison Ave. upon additional terms and conditions acceptable to the Director of Law and the Director of Utilities.

 

                     SECTION 2.                     That an expenditure in an amount not to exceed $200,000 is authorized from Account Code 2016-38000-6G10405STDSTD (Brownfield Revolving Loan) for the purpose listed in Section 1. 

 

                     SECTION 3.  That the Finance Director is authorized to draw his or her warrant or warrants against the above mentioned Account Code in payment of the above authorized obligations upon presentation of the proper voucher or vouchers. 

 

                     SECTION 4. That it is found and determined that all formal actions of City Council concerning and relating to the passage of this Ordinance were taken in an open meeting of City Council, and that all deliberations of City Council and any of its committees that resulted in such formal action, were in meetings open to the public, in compliance with all legal requirements, including those of Section 121.11 of the Ohio Revised Code.

 

                     SECTION 5.  That this Ordinance is declared to be an emergency measure and shall be in force and effect from and after its passage.  The reason for the emergency lies in the fact that it is necessary for the immediate preservation of the public peace, health, safety, and property, and for the further reason that the Ordinance must be immediately effective in order to facilitate the timely completion of the environmental remediation of the property located at 2100-2144 Madison Ave. in Toledo according to U.S. EPA’s designated time schedule.
