Title

Authorizing the expenditure of an amount not to exceed $200,000 from the 2017 Matches & Planning Program in the Capital Improvement Program Fund for matching funds for design of a project; authorizing the Mayor to enter into agreements with the Toledo-Lucas County Port Authority for the Front/Millard Roadway Improvement Project related to the Cliffs Natural Resources, Inc. hot briquetted iron plant development; and declaring an emergency.

Body

SUMMARY & BACKGROUND:

The Division of Engineering Services is requesting authorization to expend up to $200,000 from the 2017 Matches & Planning program, in which this expenditure was anticipated and budgeted, to fund the local share of costs to design the roundabouts at the Front/Millard and the Millard/Tiffin intersections.  This is part of the agreed upon street improvements to be provided by a partnership of the City of Toledo and the Toledo-Lucas County Port Authority (Port) adjacent to and related to the new hot briquetted iron plant being constructed by Cliffs Natural Resources, Inc. in East Toledo.  The Port has received grants for construction of these roadway improvements and will combine those funds with a previous grant the City had received for resurfacing and repair of Front from Millard to I-280 to complete the roadway improvements that are part of the Cliffs Project.  The Port will take the lead in administering the construction contracts and will provide matching funds for the resurfacing grant thereby reducing the City’s needed funding commitment for the project to the $200,000 noted.  As part of that effort they are requesting that the city provide the local match for design of the roundabout portion of the project. The necessary money is budgeted and was anticipated.

Summary

NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:

SECTION 1.  That the Mayor is authorized to enter into agreements for the local match of grant funded costs for design of the Front/Millard and Millard/Tiffin roundabouts that are part of Front and Millard roadway improvements related to the Cliffs Natural Resources, Inc. iron plant.  Agreements shall contain such terms and conditions as the Mayor may deem requisite and proper and shall be subject to approval by the Directors of Law and Public Utilities.

SECTION 2.                     That an expenditure in an amount not to exceed $200,000 is authorized from the Matches and Planning Program of the Capital Improvement Fund, Account Code 5040-35000-8CP1705STREET, for the purpose listed in Section 1.

SECTION 3.  That the Finance Director is authorized to issue his warrant or warrants against the Account Code identified in Section 2 in an amount not to exceed $200,000 in payment of the above authorized obligations upon presentation of proper voucher or vouchers.

SECTION 4.                      That the disappropriation of any remaining budget to fund balance is authorized at project closeout.

SECTION 5.                     That this Ordinance is declared to be an emergency measure and shall be in force and effect from and after its passage.  The reason for the emergency lies in the fact that this Ordinance is necessary for the immediate preservation of the public peace, health, safety, and property and for the further reason that this Ordinance must be immediately effective in order to facilitate this work beginning early this year to meet completion deadlines.
