SUMMARY & BACKGROUND:

In 1994 the State of Ohio revised ORC Section 6109.21 to require all municipal water treatment facilities pay an annual licensing fee to operate a water treatment plant.  The fee is based on the total number of service connections that exist in the distribution system.  The Toledo system has 133,361 connections.  According to the rate structure, each tap costs $0.86 for a total of $114,690.46.  The license is renewable upon proper application each year.  All fees are placed in a special account for use by the Ohio Environmental Protection Agency in water related programs.  The fee payment is due by December 31, 2017, which is thirty days before the expiration of the current license or 10% (ten percent) late penalties may be imposed.

 

Summary

NOW, THEREFORE, Be it ordained by the Council of the City of Toledo.

 

                     SECTION 1.   That an expenditure of $114,690.46 from the Water Operating Fund Account Code 6060-32000-4000511STDSTD is authorized for the renewal of the Ohio Environmental Protection Agency Public Water System License for the year 2018 for the operation of the City of Toledo’s Water Treatment Facility.

 

                     SECTION 2.  That the Finance Director is authorized to issue his warrant or warrants against the Account Code listed in Section 1 in an amount not to exceed $114,690.46 in payment of the obligations incurred above upon presentation of the proper voucher or vouchers.

 

                     SECTION 3.  That this ordinance is declared to be an emergency measure and shall be in force and effect from and after its passage.  The reason for the emergency lies in the fact that same is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that this ordinance must be effective immediately in order to permit the city of Toledo to continue to operate and to thereby provide top-quality potable water to its many customers throughout the region.
