SUMMARY & BACKGROUND:
Former City of Toledo employee David Sanders has filed a grievance through his union challenging his termination. That grievance is pending a hearing before an arbitrator. Mr. Sanders also filed a charge of employment discrimination with the Ohio Civil Rights Commission (OCRC). Following negotiations, an agreement has been reached in the amount of $60,000 as to all claims, including a release of all claims without any admission of liability for any violation of state or federal law.

Summary
NOW THEREFORE Be it ordained by the Council of the City of Toledo:

SECTION 1. That the expenditure of $60,000 is authorized from the Risk Management Fund Account Code 7095-12000-1157001STDSTD for the settlement of all claims alleged by David Sanders against the City of Toledo.

SECTION 2. That the payment of these claims is contingent upon the execution of the proper releases by David Sanders.

SECTION 3. That the Director of Finance is authorized to draw their warrant or warrants to David Sanders and/or his legal counsel in the sum of $60,000 against the above Account Code in payment of the above-authorized obligations upon presentation of the proper vouchers therefore.

SECTION 4. That this ordinance being an emergency measure shall be in force and effect from and after its passage. The reason for the emergency lies in the fact that this ordinance is necessary for the immediate preservation of the public peace, health, safety and property and for the further reason that this ordinance must be immediately effective in order to timely implement the settlement in accordance with the agreement....
