Authorizing the settlement of the property damage claim of Sterling Consultants, Inc. dba Sterling Laboratories, Inc. against the City of Toledo for the sum of $61,419.45 from the Risk Management Fund; and declaring an emergency.

SUMMARY & BACKGROUND:

On July 26, 2023, Sterling Laboratories, Inc. suffered $61,419.45 in damages to their property at 970 S. Byrne Rd. Toledo, Ohio as a result of water line work being performed nearby by the City of Toledo. 

 

Summary

NOW THEREFORE, Be it ordained by the Council of the City of Toledo:

 

                     SECTION 1.  That an expenditure of an amount of $61,419.45 is authorized from the Risk Management Fund Account Code 7095-12000-1157001STDSTD for the purpose of the claim settlement of Sterling Consultants, Inc.

 

                     SECTION 2.  That payment authorized in Section 1 is contingent upon the execution and delivery of a proper release by the claimant.

 

                     SECTION 3. That the Director of Finance is authorized to draw their warrant or warrants to Sterling Consultants, Inc. in the amount of $61,419.45 against the above Account Code in payment of the above-authorized obligations and upon presentation of the proper vouchers.

 

SECTION 4.  That this Ordinance being an emergency measure shall be in force and effect from and after its passage. The reason for the emergency lies in the fact that this ordinance is necessary for the immediate preservation of the public peace, health, safety and property and for the further reason that this Ordinance must be immediately effective in order to timely implement the claim settlement.

 

Vote on emergency clause:  yeas 11, nays 0.
