SUMMARY & BACKGROUND
The City of Toledo seeks to promote prosperous development, promote public health, safety, and welfare, and ensure land use regulations reflect the current and future needs of the community. The proliferation of gasoline and fuel sales stations have impacts related to traffic congestion, environmental concerns, land use compatibility, and long-term economic development.
Toledo City Council finds it necessary to request the Toledo Plan Commission study spacing requirements, square footage allowance, 24-hour special use permits, licensing as outlined in Toledo Municipal Code Chapter 721, and Neighborhood Commercial zoning code as it relates to gasoline and fuel sales stations.
A temporary moratorium is necessary to allow time for the study to occur and to prevent the establishment of uses that may be inconsistent with future regulatory changes. This moratorium will apply to new gasoline and fuel stations as well as expansions of existing gasoline and fuel stations that increase fuel dispensing capacity. This moratorium will not apply to routine maintenance or repair of existing facilities that do not expand capacity or project that have received all necessary approvals and permits prior to the effective date of this Ordinance
