Title
Amending Ordinance 485-23 for the purpose of adding a section authorizing the waiver of competitive bidding under Toledo Municipal Code Chapter 187; and declaring an emergency.

SUMMARY & BACKGROUND:
This Ordinance amends Ordinance 485-23 to allow the waiver of competitive bidding for the purchase of vehicles and equipment for the Police Department. The list of vehicles and equipment include Marked Vans, Unmarked Sedans and SUV's, Passenger Vans and a SIU Van.

After several failed attempts utilizing the formal bid process to acquire Police Vans, Detective's Sedans, and Unmarked units, passing this ordinance, will allow the city to enter into agreements with local dealers utilizing what is available for purchase on the lot and waiving competitive bidding. Funds have been approved for expenditure from the Capital Improvement Fund.

Summary
NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:

SECTION 1. That Ordinance 485-23 is amended to add a new Section 5 which reads as follows:

SECTION 5. That this Council finds and determines that it is in the best interest of the City to waive the competitive procurement requirements of Toledo Municipal Code Chapter 187 for the purchase of the subject equipment considering limited availability in the prevailing equipment supply-chain market and where the Director of Public Service further finds and determines that the subject equipment is not available utilizing competitive procurement and the cost thereof is deemed competitive and reasonable.

SECTION 2. That this Ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage. The reason for the emergency lies in the fact that the same is necessary for the immediate preservation of the public peace, health, safety...
