Title
Requesting the termination and non-renewal of all City of Toledo agreements with Flock Group, Inc. and its affiliates; requesting the removal or deactivation of Flock equipment; requesting the deletion of Flock generated data consistent with applicable law; and declaring an emergency.

Summary
WHEREAS, the City of Toledo has authorized the mayor to enter into various agreements with Flock Group, Inc. relating to automatic license plate readers, Flock OS, exterior camera systems, and other related products and services; and

WHEREAS, Toledo City Council previously authorized agreements concerning Flock automatic license plate readers through Ordinance 591-24, Ordinance 512-25, Ordinance 241-26, and Ordinance 286-26; and

WHEREAS, City Council finds that public resources should not be committed to the continued purchase, licensing, maintenance, or subscription of Flock products or services when we have determined that such expenditures are not in the best interest of the City; and

WHEREAS, the continuation of Flock technology within the City of Toledo raises significant questions concerning privacy, civil liberties, data security, data retention, accountability, and the appropriate limits of surveillance; and

WHEREAS, Flock’s technology has expanded beyond traditional license plate recognition to create an interconnected network of surveillance capable of collecting information about vehicles traveling on public roads across municipal and jurisdictional boundaries; and

WHEREAS, the City Council recognizes that the constitutional and legal standards applicable to emerging surveillance technologies continue to develop and that municipalities should exercise caution before creating surveillance systems whose capabilities may exceed existing legal and policy safeguards.
