SUMMARY & BACKGROUND:
On June 26, 2024 the chemical building at the Division of Water Treatment sustained flooding damage to stockpiles of lime and soda ash and required extensive clean-up efforts. The cause was determined to be a Storm Water Pollution Prevention device maintained by Shook Construction, a contractor at Collins Park. Shook's insurer, Travelers Insurance, has come to an agreement with the City's clean up vendor, Young's Environmental, and the City, to reimburse Young for $129,476 and Water Treatment for $77,852.
Summary
NOW THEREFORE Be it ordained by the Council of the City of Toledo:
SECTION 1. That acceptance of $77,852 from Travelers Insurance in settlement of Toledo's claim against Shook is approved and the deposit of same is authorized into the Water Operating Fund Account Code 6060-32000-4000503STDSTD.
SECTION 2. That the Mayor is authorized to execute and deliver a release of claims under such terms and conditions that are acceptable to the Director of Law.
SECTION 3. That this Ordinance being an emergency measure shall be in force and effect from and after its passage. The reason for the emergency lies in the fact that this Ordinance is necessary for the immediate preservation of the public peace, health, safety and property and for the further reason that Water Treatment needs to be made whole after expending funds to clean up following the flood and replace damaged chemicals.
