SUMMARY & BACKGROUND:
The City entered into a 40-year contract with Wood County on January 13,1985 for sewer services over a portion of northern Wood County. In 1994 the Northwest Water and Sewer District ("NWWSD") was created and assumed all of Wood County's assets and obligations for this contract. That contract is expiring soon but both parties are in the process of evaluating long term goals and are not ready to negotiate another full, 40-year contract at this time. This ordinance will authorize the Mayor to execute a one-year extension on the existing contract with all terms to remain the same. The authorization to execute a one-year extension was recently approved by NWWSD via Resolution 2024-144 on November 7, 2024.
Summary
NOW THEREFORE Be it ordained by the Council of the City of Toledo:
SECTION 1. That the Mayor is authorized to execute a one-year extension of the 1985 sewer contract with NWWSD upon the conditions acceptable to the Director of Law and the Director of Public Utilities.
SECTION 2. That this Ordinance is declared to be an emergency and shall take effect and be in force from and after its passage. The reason for the emergency lies in the fact that this Ordinance is necessary for the immediate preservation of the public peace, health, safety and property of the City and for the further reason that this Ordinance must be immediately effective for the continuity of the utility arrangements between Toledo and NWWSD.
