Authorizing the appropriation of $149,387 from the unappropriated balance of the Sewer Replacement Fund for the 2024 annual lease payment to Norfolk Southern Railway for the Downtown CSO Storage Basin; and declaring an emergency.

Body

SUMMARY & BACKGROUND:

Ordinance 65-15 authorized a twenty-year agreement with Norfolk Southern Railway for the lease and subsequent purchase of approximately 9.1 acres of land to construct the Downtown CSO Storage Basin as required by the approved Consent Decree. Furthermore, it authorized the annual expenditure of future years’ lease payments subject to appropriation.

Summary

NOW THEREFORE Be it ordained by the Council of the City of Toledo:

SECTION 1. That an amount not to exceed $149,387 is appropriated from the Sewer Replacement Fund to Account Code 6073-36000-4UC1914STDSTD for the 2024 annual lease payment to Norfolk Southern Railway for the Downtown CSO Storage Basin.

SECTION 2. That the disappropriation of any remaining budget to fund balance is authorized at project closeout.
