Repealing Ordinance 506-80 in its entirety, a proposed zone change conditioned upon the recording of a commercial plat for a property located at 1346, 1376 and 1400 E. Broadway St.; and declaring an emergency.

SUMMARY & BACKGROUND:
On July 15,1980, City Council passed Ord. 506-80, attached hereto as "Exhibit A," which was a zone change conditioned upon the recording of a commercial plat. The ownership of the property has transferred and the plat was never recorded. The repeal of this ordinance will clear any cloud existing on in the chain of title and clarify that the proper zoning remains "M-2" Heavy Industrial. Repeal of Ordinance 506-80 comes at the request of the current property owner and with the consent of the Plan Director.
Summary
NOW THEREFORE Be it ordained by the Council of the City of Toledo:
SECTION 1. That Ordinance 506-80 attached and incorporated by reference as "Exhibit A" is hereby repealed in its entirety.
SECTION 2. That this Ordinance is hereby declared to be an emergency measure and shall be in force and effect from and after its passage. The reason for the emergency lies in the fact that same is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that this Ordinance must be immediately effective so that the affected property may be cleared of any title encumbrance.
