Title

Amending Toledo Municipal Code to enact a new Section 1111.0610 “Zone Changes Subject to Subdivision Platting” and declaring an emergency.

SUMMARY & BACKGROUND:

This ordinance enacts a new section of the Toledo Municipal Code (“TMC”) to update the local planning regulations to provide greater clarity to prospective developers.  The change will streamline the planning process, reduce administrative review, and ensure consistent regulatory framework going forward. This change is consistent with the City’s Forward Toledo Comprehensive Land Use Plan and stated purpose of the Zoning Code.

 

Summary

NOW THEREFORE Be it ordained by the Council of the City of Toledo:

 

                     SECTION 1. That Toledo Municipal Code §1111.0610 is enacted to state as follows: 

 

§1111.0610 Zone Changes Subject to Subdivision Platting

 

 Any Zone Change conditionally approved subject to the approval and recording of a commercial or industrial subdivision plat, is no longer valid.  The zoning classification that existed prior to the conditional approval shall remain the zoning classification for the subject property.

 

                      SECTION 2.  That this Ordinance hereby is declared to be an emergency measure and shall be in force and effect from and after its passage. The reason for the emergency lies in the fact that the same is necessary for the immediate preservation of the public peace, health, safety and property, and that this Ordinance must be immediately effective in order to provide accurate and complete standards for use by property owners.

 

Vote on emergency clause:  yeas 10 nays 0.

 

Adopted:  March 3, 2026, as an emergency measure:  yeas 10, nays 0.
