Title
Repealing Ordinance 10-25; authorizing the Mayor to enter into a contract for emergency repair assessment services to the sanitary sewer at Arlington and Francis with Hillabrand & Sons Construction, LLC; waiving the competitive bidding provisions of TMC Chapter 187; and declaring an emergency.

SUMMARY & BACKGROUND:
An existing 48" sanitary sewer, 45 feet below ground, located at Arlington and Francis has collapsed causing a sinkhole in the pavement. Due to the emergency repair needed, the Division of Engineering and Construction Management requested quotes from six contractors. Hillabrand & Sons Construction provided the only bid and has been contracted to begin the investigation immediately.
Funding for this repair is authorized through Ord. 146-20, Large Diameter Sewer Replacement and Ord. 10-24, Various Sewer Replacements and Improvements. This Ordinance will allow the division to waive competitive bidding in order to immediately begin investigation in an effort to preserve the health, safety, and property of the general public. Ordinance 10-25 is being repealed as the initially identified contractor is no longer available.
Summary
NOW THEREFORE Be it ordained by the Council of the City of Toledo:
SECTION 1. That attached Ordinance 10-25 is repealed in its entirety.
SECTION 2. That the Mayor is authorized to enter into a contract with Hillabrand and Sons Construction, LLC. for emergency repair assessment services to the sanitary sewer at Arlington and Francis, upon such terms and conditions approved by the Director of Transportation and the Director of Law.
SECTION 3. That this Council finds and determines that it is in the best interest of the City to waive the competitive bidding provisions of TMC Chapter 187 for the reason that Hillabrand and Sons Construction, LLC. has significant institutional know...
