SUMMARY & BACKGROUND:
Under Ohio law, a motel or hotel with more than five guest rooms that offers accommodations for stays of fewer than 30 days must be licensed through the State Fire Marshal within the Ohio Department of Commerce, pursuant to Ohio Revised Code Section 3731.03. While this state licensing requirement establishes an important baseline for safety and operation, it does not prevent municipalities from adopting additional regulations to address local concerns.
Several Ohio cities have recognized the value of local oversight and have taken steps to supplement state requirements. These approaches provide local governments with greater visibility into hotel and motel operations and an additional mechanism for addressing properties that fail to meet community standards.
Toledo currently lacks a comparable local regulatory framework. When complaints involving illegal activity at Toledo motels and hotels are received, they are forwarded to the State Fire Marshal for investigation. While state enforcement remains an important component of oversight, relying solely on a state agency can limit the City's ability to respond quickly and effectively to recurring problems at targeted properties. Local officials are often in the best position to identify patterns of activity, respond to neighborhood concerns, and hold property owners and operators accountable for conditions occurring within the City.
This ordinance does not replace the State Fire Marshal's authority; rather, it gives the City an additional tool to supplement state oversight, strengthen accountability, and protect the safety and quality of life of Toledo residents.
