Title

Resolution in support of the city of Toledo application to the Ohio Department of Natural Resources Division of Watercraft for the purpose of obtaining navigational aids in federal navigable waters; and declaring an emergency.

Body

SUMMARY & BACKGROUND:

The Division of Streets, Bridges and Harbor maintains the navigational aids, also known as buoys, within the navigable waterway of Maumee Bay.  The GPS locations, sizes, colors and markings of these buoys, are approved by the United States Coast Guard and recorded at the Ohio Department of Natural Resources (ODNR).  ODNR provides a means to receive replacement buoys and buoy markers at no cost for federally navigable waters through a grant program.  Passage of this Resolution supports the grant application prepared and submitted by the Department of Public Service, Division of Streets, Bridges & Harbor.

Summary

NOW, THEREFORE, Be it resolved by the Council of the City of Toledo:

SECTION 1.  That the Ohio Department of Natural Resources administers a grant program for replacement navigational aids for federally navigable waters and that the city of Toledo desires to seek this assistance in calendar year 2018.

SECTION 2.  That the Mayor is authorized to prepare and file application to ODNR for replacement buoys and to provide all information and documentation required to become eligible to receive replacement buoys.

SECTION 3.  That, if the grant applied for is awarded, the City of Toledo agrees to accept the replacement buoys and place them and maintain them as directed by ODNR and the United States Coast Guard.

SECTION 4.  That this Resolution is declared to be an emergency measure and shall be in force and effect from and after its passage.  The reason for the emergency lies in the fact that same is necessary for the preservation of the public peace, health, safety and property and for the further reason that this Resolution must be immediately effective in order to facilitate the grant application.
