Title
Authorizing the Mayor to enter into and execute cooperative agreements and to accept financial assistance from the Washington Local School District for the Whitmer Drive construction project; authorizing the acceptance, deposit, appropriation and expenditure of grant proceeds into the Capital Improvement Fund in an amount not to exceed $1,750,000; authorizing the Mayor to accept bids and award contracts for said project; and declaring an emergency.

SUMMARY & BACKGROUND:
The City of Toledo is reconstructing and relocating Whitmer Drive from Tremainsville Road to Alexis Road and adding a multi-use path and safety features. The project is scheduled to construct in the Spring of 2025.
The project will move Whitmer Drive to the west at the existing parking lot for Washington Local Schools. The current location for Whitmer Drive will become the new parking lot location for Washington Local. The new road and parking lot will be built with the same construction contract, and Washington Local will agree to pay for those added features. A Joint Cooperation Agreement will be signed between the two entities that will vacate the existing Whitmer Drive right of way, and will allow for a separate purchase agreement for the portion of land that will be dedicated.
Summary
NOW THEREFORE Be it ordained by the Council of the City of Toledo:
SECTION 1. That the Mayor is authorized to enter into and execute cooperative agreements with and accept financial assistance from the Washington Local School District upon such terms and conditions as shall be approved by the Director of Transportation and the Director of Law.
SECTION 2. That the Mayor is authorized to accept and deposit grant proceeds from the Washington Local School District into the Capital Improvement Fund Account Code 540G-35000-8G07066STDSTD in an amount not to exceed $1,750,000 for the Whitmer Drive project.
SECTION 3. That the sum of $1,750,000 is appropriated from the grant proceeds of the Capital Improvement Fund into the account code listed in Section 2 for the project listed above; and authorizing expenditure of same for the Whitmer Drive project.
SECTION 4. That the Mayor is authorized to prepare plans and specifications, accept bids and to enter into contracts including such items as labor, materials, construction, testing, professional services, property appraisals, title work, negotiations, acquisition, and environmental contamination studies that are necessary to acquire additional rights-of-way. Contracts shall contain such terms and conditions as the Mayor may deem requisite and proper and shall be subject to approval by the Director of Transportation and the Director of Law.
SECTION 5. That the Finance Director is authorized to issue their warrant or warrants against the Account Code identified in Section 2 in an amount not to exceed $1,750,000 in payment of the above-authorized obligations upon presentation of the proper voucher or vouchers.
SECTION 6. That this Ordinance is declared to be an emergency measure and shall be in force and effect from and after its passage. The reason for the emergency lies in the fact that this Ordinance is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that this Ordinance must be immediately effective in order to facilitate the planning and construction of this project.
