SUMMARY & BACKGROUND:

This Ordinance authorizes the Mayor to enter into an agreement with Columbia Gas of Ohio to pay for its right-of-way permit fees in bulk, annually, for a five-year term.  Columbia Gas of Ohio will still abide by all safety and procedural requirements contained within the Toledo Municipal Code as well as Toledo’s Engineering and Construction Management Division’s internal practice and procedure guidelines.  Columbia Gas of Ohio will pay a lump sum of $350,000 per year for each year of the five-year term. 

 

Summary

NOW THEREFORE Be it ordained by the Council of the City of Toledo:

 

                     SECTION 1.                     That the Mayor is authorized to enter into an agreement with Columbia Gas of Ohio that allows for the bulk payment of right-of-way fees in an amount not to exceed $350,000 annually for a term of five years, upon terms and conditions acceptable to the Director of Public Utilities and the Director of Law.

 

SECTION 2. That the Finance Director is authorized to accept and deposit an amount not to exceed $350,000 annually for said right-of-way permit fees into the General Fund Account Code 1001-35000-406440-5651003STDSTD.

            

                     SECTION 3. That this Council finds and determines it is in the best interest of the city to waive the permit fees of TMC Chapter 945 to the extent they are inconsistent with the agreement authorized in Section 1.

 

SECTION 4.  That this Ordinance is declared to be an emergency measure and shall be in force and effect from and after its passage.  The reason for the emergency lies in the fact that it is necessary for the immediate preservation of the public peace, health, safety, and property, and for the further reason this Ordinance must be immediately effective in order to receive Columbia Gas of Ohio’s fees for 2024 and to effectuate the terms of the agreement expeditiously.

 

Vote on emergency clause:  yeas 11, nays 0.
