SUMMARY & BACKGROUND:

This Ordinance repeals Ordinance 72-22, which authorized an expenditure for golf carts. This Ordinance authorizes a new lease agreement for golf carts with Lake Erie Golf Cars, LLC for a five-year term at $90,720 per year, financed through PNC Equipment Finance, LLC. Competitive procurement requirements are waived for the reason that Lake Erie Golf Cars, LLC is the recommended golf cart vendor by the City’s current golf course management company, The Davey Tree Expert Company.

 

Summary

NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:

 

                     SECTION 1. That Ordinance 72-22 is repealed in its entirety.

 

                     SECTION 2. That the Mayor is authorized to enter into a five-year golf cart lease agreement with Lake Erie Golf Cars, LLC financed through PNC Equipment Finance, LLC.

 

                     SECTION 3. That this Council finds and determines it is in the best interest of the City to waive the competitive procurement requirements of Toledo Municipal Code Chapter 187 for the reason that the City’s current golf course management company, The Davey Tree Expert Company, recommends the leasing of golf carts in accordance to Section 2 is in the best interest of golf course operations.

 

SECTION 4. That subject to annual appropriations in future years, the expenditure in the amount of $90,720 annually over the term of the agreement authorized in Section 2 is authorized from the Golf Improvements Fund Account Codes 2005-40100-5C13804STDSTD, 2005-40100-5C13805STDSTD and 2005-40100-5C13806STDSTD for golf cart lease payments.

 

                     SECTION 5.  That the Finance Director is authorized to draw warrant or warrants against the Account Codes in Section 4 in an amount not to exceed $90,720 annually in payment of the above authorized obligations upon presentation of the proper voucher or vouchers.

 

                     SECTION 6.  That this Ordinance be an emergency measure and shall take and be in force and effect after its passage. The reason for the emergency lies in the fact that this Ordinance is necessary for the immediate preservation of the public property and further reason that this Ordinance must be immediately effective in order to continue the golf course operations so as to avoid any interruption to the 2022 golf season.

 

Vote on emergency clause:  yeas 12, nays 0.
