SUMMARY & BACKGROUND:
The Toledo Fire & Rescue Department currently uses the Electronic Patient Care and National Fire Incident Reporting software for processing of electronic patient care and national fire incident reporting requirements as mandated by NEMSIS, the Ohio State Fire Marshal, and all other applicable codes and laws. This Ordinance authorizes the Mayor to amend the existing agreement for an additional 3 years with the option to renew for two additional one-year terms for the continuation of the software services through ESO Solutions, Inc. not to exceed $105,000 annually.
Summary
NOW THEREFORE Be it ordained by the Council of the City of Toledo:
SECTION 1. That the Mayor is authorized to amend an existing software license agreement with ESO Solutions, Inc for an additional three years with the option to renew for two additional one-year terms, for Electronic Patient Care & National Fire Incident Reporting software use upon such terms and conditions as approved by the Director of Fire and Rescue and the Director of Law.
SECTION 2. That subject to appropriation, the expenditure of an amount not to exceed $105,000 annually is authorized from the General Fund Account Code 1001-53000-341002STDSTD for the software authorized in Section 1.
SECTION 3. That this Council finds and determines it is in the best interest of the City to waive the competitive bidding requirements of TMC Chapter 187 for the reason that ESO Solutions, Inc. is the current vendor for the Electronic Patient Care & National Fire Incident Reporting software continuing with ESO Solutions, Inc. maintains system compatibility and costs for training and implementation of a new software would be prohibitive.
SECTION 4. That the Director of Finance is authorized to draw their warrant or warrants against the Account Code listed above in an amount not to exceed $105,000 annually in payment of the above-authorized obligations upon presentation of the proper voucher or vouchers.
SECTION 5. That this Ordinance is declared to be an emergency measure and shall be in force and effect from and after its passage. The reason for the emergency lies in the fact that it is necessary for the immediate preservation of the public health, safety and property, and to facilitate the uninterrupted processing of electronic patient care and national fire incident reporting requirements as mandated by NEMSIS, the Ohio State Fire Marshal, and all other applicable codes and laws.
