SUMMARY & BACKGROUND:
This Ordinance authorizes expending an amount not to exceed $150,000 for design services for a new Savage Park splash pad. Funds for improvements at Savage Park were included in the approved 2024 Capital Improvement Plan (CIP) budget. Additionally, this Ordinance authorizes the waiver of competitive procurement for the design services in order to accelerate the timeline for replacement of the splash pad so it will be operable in the summer of 2025.
Summary
NOW THEREFORE Be it ordained by the Council of the City of Toledo:
SECTION 1. That the Mayor is authorized to enter into a professional services contract for the design of a new Savage Park splash pad, upon terms and conditions acceptable to the Director of Law and the Director of Parks and Youth Services.
SECTION 2. That the expenditure of an amount not to exceed $150,000 is authorized from the Capital Improvement Fund Account Code 5040-40100-8CP2414SAVPRK for the purpose authorized in Section 1.
SECTION 3. That this Council finds and determines it is in the best interest of the City to waive the competitive procurement requirements of Toledo Municipal Code Chapter 187 for the reason that expedited design is necessary in order ensure that the new splash pad is opened for the summer of 2025 for the surrounding neighborhood.
SECTION 4. That the Finance Director is authorized to draw warrant or warrants against the above Account Code in payment of the above authorized obligations in amounts not to exceed $150,000 upon presentation of the proper voucher or vouchers.
SECTION 5. That this Ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage. The reason for the emergency lies in the fact that the same is necessary for the immediate preservation of the public peace, health, safety and property and for the further reason that this Ordinance must be immediately effective in order to immediately begin design of the new Savage Park splash pad so it can be constructed prior to the summer of 2025.
