SUMMARY & BACKGROUND:

This Ordinance authorizes expending an amount not to exceed $130,000 from the appropriated Capital Improvement Fund to purchase two passenger vans primarily used for Fire Trainee transport.

 

Since 2021, Facilities has solicited related bids pursuant to TMC Chapter 187 on multiple occasions, none of which materialized into deliveries for various reasons, including zero bid responses to contract cancellations due to product unavailability, which collectively indicates limited stock due to market volatility. On 6/27/23, Facilities located and reserved a van that's deliverable by the 7/28/2023 Academy start date. Accordingly, to secure immediately available personnel transportation in time for the coming Academy, Fire requests to waive competitive bidding.

 

Summary

NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:

 

                     SECTION 1. That an expenditure sum in an amount not to exceed $130,000 is authorized from Capital Improvement Fund, Account Codes 5040-53000-8CP2138FIRVEH and 5040-53000-8CP2305FIREQP for the purchase of two passenger vans.

 

                     SECTION 2. That this Council finds it in the best interest of the City to waive the competitive procurement requirements of Toledo Municipal Code Chapter 187 for the purchase of two passenger vans for the reason of timely vehicle delivery for 2023's Fire Academy.

 

SECTION 3. That the Mayor is authorized to enter into contracts necessary to complete said purchases and that said contracts shall contain such terms and conditions as the Mayor may deem requisite and proper and shall be subject to approval by the Department of Law and Director of Fire and Rescue.

 

                     SECTION 4. That the Director of Finance is authorized to issue warrant or warrants against the Account Codes mentioned in Section 1 in payment of the above authorized obligations in an amount not to exceed $130,000 upon presentation of the proper voucher or vouchers.

 

SECTION 5. That this Ordinance is declared to be an emergency measure and shall be in force and effect from and after its passage. The reason for the emergency lies in the fact that same is necessary for the immediate preservation of the public peace, health, safety, and property and for the further reason that this Ordinance must be immediately effective to expedite the purchase and delivery of passenger transport vans for the 2023 Fire Academy.
